A bill for an act
relating to retirement; allowing certain persons to select a joint and survivor
benefit from the Public Employees Retirement Association.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Notwithstanding any law to the contrary, an eligible person may elect to receive a
joint and survivor benefit from the Public Employees Retirement Association. An eligible
person must make this election within 60 days of the effective date of this act, in a manner
specified by the executive director of the Public Employees Retirement Association. An
election under this section is irrevocable. At the time of making an election to receive
a joint and survivor benefit under this section, an eligible person must pay the Public
Employees Retirement Association the difference between:

(1) the amount of the single-life benefit the person received from December 2004
until making an election under this section; and

(2) the amount of the joint and survivor benefit the person would have received if the
person had been receiving a joint and survivor benefit since December 2004.

(b) For purposes of this section, an eligible person is a person who:

(1) was employed by Hennepin County as a human services representative until
September 1, 2004;

(2) began receiving a disability benefit from the Public Employees Retirement
Association in December 2004; and

(3) was notified in January 2005 that the person was approved to receive Social
Security disability benefits.

Section 1 is effective the day following final enactment.
