A bill for an act
relating to public safety; increasing criminal
penalties involving regulated animals; amending
Minnesota Statutes 2004, section 346.155, subdivision
10.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 346.155,
subdivision 10, is amended to read:


Subd. 10.

Penalty.

new text begin (a) new text end A person who knowingly violates
subdivision 2, 3, or 4 is guilty of a new text begin gross new text end misdemeanor.

new text begin (b) Unless a greater penalty is provided elsewhere, a
person who possesses a regulated animal that causes bodily
injury, as defined in section 609.02, subdivision 7, to another
person is guilty of a felony and may be sentenced to
imprisonment for not more than two years or to payment of a fine
of not more than $5,000, or both, if the person negligently
failed to control the animal or keep it properly confined and
injury to any person was reasonably foreseeable under the
circumstances.
