1E Establishing the conditional release board with the authority to release certain nonviolent controlled substance offenders meeting certain requirements, specifying board membership requirements including a certain number of public members with certain qualifications to be appointed by the governor; providing for offender petitions to the board for conditional release before the scheduled supervised or target release dates under certain conditions; requiring the commissioner of corrections to offer offenders meeting the conditions chemical dependency treatment and specifying certain release procedures, requiring board determination of no danger to the public and offender completion of other sentences before release; authorizing the filing of petitions for the sealing of records relating to certain controlled substance offenses under certain conditions; providing for the release of certain controlled substance offenders currently in prison, requiring the board to ensure advance notice of petitions for conditional release to the prosecutorial authorities responsible for conviction of the offenders, restricting conditional release to offenders committing the crime as a result of a controlled substance addiction and not primarily for profit; authorizing the court to stay sentences for certain controlled substance possessors under certain conditions, authorizing the imposition of appropriate terms and conditions and requiring offender completion of a chemical dependency treatment program designated by the court, specifying certain program requirements and authorizing the court to require the offender to pay the costs of the treatment program; requiring the court to consider the results of presentence investigations before sentencing the offenders; excluding offenders previously convicted or adjudicated delinquent for a violent crime or of possession of a dangerous weapon at the time of arrest from eligibility for stayed sentences
