1.1 A bill for an act 1.2 relating to natural resources; state lands; modifying 1.3 requirements for designation of scientific and natural 1.4 areas; authorizing the private sale of certain surplus 1.5 state lands; authorizing the public and private sale 1.6 of certain tax-forfeited lands bordering public 1.7 waters; providing for an easement on state land 1.8 bordering a public water; amending Minnesota Statutes 1.9 2004, sections 84.033, by adding a subdivision; 1.10 97A.093; Laws 2003, First Special Session chapter 13, 1.11 section 25; repealing Minnesota Statutes 2004, section 1.12 84.033, subdivision 2. 1.13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.14 Section 1. Minnesota Statutes 2004, section 84.033, is 1.15 amended by adding a subdivision to read: 1.16 Subd. 3. [COUNTY APPROVAL.] (a) The commissioner must 1.17 follow the procedures under section 97A.145, subdivision 2, when 1.18 acquiring land for designation as a scientific and natural area 1.19 under this section. 1.20 (b) When designating land that was not acquired under this 1.21 section as a scientific and natural area the commissioner must 1.22 obtain approval of the designation by resolution of the board of 1.23 the county in which the land is located. 1.24 Sec. 2. Minnesota Statutes 2004, section 97A.093, is 1.25 amended to read: 1.26 97A.093 [HUNTING, TRAPPING, AND FISHING IN SCIENTIFIC AND 1.27 NATURAL AREAS.] 1.28 Except as otherwise provided by law, scientific and natural 1.29 areas are closed to hunting, trapping, and fishing unless: 2.1 (1)for scientific and natural areas designated before May2.215, 1992,the designating document allows hunting, trapping, or 2.3 fishing; or 2.4 (2)for other scientific and natural areas,the 2.5 commissioner allows hunting, trapping, or fishing in accordance 2.6 with the procedure in section 86A.05, subdivision 5, paragraph 2.7 (d). 2.8 Sec. 3. Laws 2003, First Special Session chapter 13, 2.9 section 25, is amended to read: 2.10 Sec. 25. [PRIVATE SALE OF SURPLUS LAND BORDERING PUBLIC 2.11 WATERS; SCOTT COUNTY.] 2.12 (a) Notwithstanding Minnesota Statutes, sections 92.45; 2.13 94.09; 94.10; 97A.135, subdivision 2a; and 103F.535, the 2.14 commissioner of natural resources shall sell by private sale the 2.15 surplus land bordering public waters that is described in 2.16 paragraph (e). 2.17 (b) The conveyance shall be in a form approved by the 2.18 attorney general for consideration of no less than the appraised 2.19 value of the land. 2.20 (c) The deed must contain a restrictive covenant that 2.21 prohibits altering, disturbing vegetation in, draining, filling, 2.22 or placing any material or structure of any kind on or in the 2.23 existing wetland area located on the land; prohibits any 2.24 increase in run-off rate or volume from the land or future 2.25 buildings into said wetland; and prohibits diverting or 2.26 appropriating water from said wetland. This restriction applies 2.27 only to the public waters wetland on the land identified on the 2.28 public waters inventory map as 70-148W. Other wetlands on the 2.29 land are subject to Minnesota Statutes, sections 103G.221 to 2.30 103G.2372. 2.31 (d) The consideration received for the conveyance shall be 2.32 deposited in the state treasury and credited to the wildlife 2.33 acquisition account in the game and fish fund. The money is 2.34 appropriated to the commissioner of natural resources for 2.35 wildlife land acquisition purposes. 2.36 (e) The land that may be sold is in the Prior Lake wildlife 3.1 management area in Scott county and is described as: 3.2 The East 1200 feet of the South 800 feet of the Southwest 3.3 Quarter of the Southeast Quarter of Section 22, Township 3.4 115 North, Range 22 West. Including the abandoned 3.5 right-of-way of the Chicago, Milwaukee, St. Paul and 3.6 Pacific Railroad Company (formerly the Hastings and Dakota 3.7 Railway Company). Containing 22 acres, more or less. 3.8 (f) This land no longer fits into the state wildlife 3.9 management area system because of hunting limitations, its small 3.10 size, and future development planned for the area. Proceeds 3.11 from the sale will be used to purchase lands more suitable for 3.12 wildlife management and public use. 3.13 [EFFECTIVE DATE.] This section is effective the day 3.14 following final enactment. 3.15 Sec. 4. [PRIVATE SALE OF CONSOLIDATED CONSERVATION LAND; 3.16 AITKIN COUNTY.] 3.17 (a) Notwithstanding the classification and public sale 3.18 provisions of Minnesota Statutes, chapters 84A and 282, or other 3.19 law to the contrary, the commissioner of natural resources may 3.20 sell the consolidated conservation land described in paragraph 3.21 (c) to Aitkin County under the remaining provisions of Minnesota 3.22 Statutes, chapters 84A and 282. 3.23 (b) The conveyance must be in a form approved by the 3.24 attorney general. The consideration for the conveyance must be 3.25 for no less than the appraised value of the land and timber, and 3.26 any survey costs. Proceeds shall be disposed of according to 3.27 Minnesota Statutes, chapter 84A. 3.28 (c) The land to be sold is in Aitkin County and is 3.29 described as: the North 400 feet of the West 800 feet of the 3.30 Northwest Quarter of the Northeast Quarter, Section 22, Township 3.31 51, Range 26. 3.32 Sec. 5. [PRIVATE SALE OF TAX-FORFEITED LAND; BELTRAMI 3.33 COUNTY.] 3.34 (a) Notwithstanding the public sale provisions of Minnesota 3.35 Statutes, chapter 282, or other law to the contrary, Beltrami 3.36 County may sell by private sale the tax-forfeited land described 4.1 in paragraph (c). 4.2 (b) The conveyance must be in a form approved by the 4.3 attorney general. The attorney general may make necessary 4.4 changes to the legal description to correct errors and ensure 4.5 accuracy. 4.6 (c) The land to be sold is located in Beltrami County, 4.7 contains 4.87 acres more or less, and is described as: a parcel 4.8 of land located north of the north right-of-way line of State 4.9 Highway 71 in the extreme northeasterly corner of the Northwest 4.10 Quarter of the Northeast Quarter, Section 32, Township 148 4.11 North, Range 32 West. 4.12 (d) The county has determined that the county's land 4.13 management interests would best be served if the lands were 4.14 returned to private ownership. 4.15 Sec. 6. [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 4.16 PUBLIC WATER OR INCLUDING WETLANDS; HENNEPIN COUNTY.] 4.17 Subdivision 1. [SALE REQUIREMENTS.] (a) Notwithstanding 4.18 Minnesota Statutes, sections 92.45, 103F.535, and 282.018, 4.19 subdivision 1, Hennepin County may sell or convey for public use 4.20 without monetary consideration to the city of Brooklyn Park, a 4.21 governmental subdivision, for an authorized public use for Storm 4.22 Water Retention Area, the parcel of tax-forfeited land bordering 4.23 public water or natural wetlands containing in excess of 150 4.24 feet of frontage on Shingle Creek, that is described in 4.25 subdivision 2, under the remaining provisions of Minnesota 4.26 Statutes, chapter 282. 4.27 (b) Any such conveyance shall be subject to restrictions 4.28 imposed by the commissioner of the Department of Natural 4.29 Resources and subject to the clause for reversion to the state 4.30 for failure to use, or abandonment of use for which the 4.31 tax-forfeited lands were acquired in Minnesota Statutes, section 4.32 282.01. 4.33 (c) The conveyance must be in a form approved by the 4.34 attorney general. 4.35 Subd. 2. [LEGAL DESCRIPTION.] (a) The parcel of land that 4.36 may be conveyed is described as: Unplatted, Section 30, 5.1 Township 119, Range 21, the East 187.1 feet of the West 1,182.6 5.2 feet of the South 597 feet of the Southwest 1/4 of the Northeast 5.3 1/4. Also that part of the Southwest 1/4 of the Northeast 1/4 5.4 lying East of the West 1,182.6 feet thereof and lying 5.5 southwesterly of Registered Land Survey No. 304. 5.6 (b) The land described must be sold under the sale 5.7 provisions in Minnesota Statutes, section 282.01. 5.8 (c) Hennepin County has determined that the county's land 5.9 management interests would best be served if the lands were 5.10 returned to private ownership or conveyed to a governmental 5.11 subdivision for an authorized public use. 5.12 [EFFECTIVE DATE.] This section is effective the day 5.13 following final enactment. 5.14 Sec. 7. [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 5.15 PUBLIC WATER OR INCLUDING WETLANDS; HENNEPIN COUNTY.] 5.16 Subdivision 1. [SALE REQUIREMENTS.] (a) Notwithstanding 5.17 Minnesota Statutes, sections 92.45, 103F.535, and 282.018, 5.18 subdivision 1, Hennepin County may sell or convey for public use 5.19 without monetary consideration to the city of Minnetrista, a 5.20 governmental subdivision, for an authorized public use for 5.21 Preservation of Wetlands and Wildlife, the parcel of 5.22 tax-forfeited land bordering public water or natural wetlands 5.23 containing in excess of 150 feet of frontage on Painter Creek 5.24 and Jennings Bay on Lake Minnetonka, that is described in 5.25 subdivision 2, under the remaining provisions of Minnesota 5.26 Statutes, chapter 282. 5.27 (b) Any such conveyance shall be subject to restrictions 5.28 imposed by the commissioner of the Department of Natural 5.29 Resources and subject to the clause for reversion to the state 5.30 for failure to use, or abandonment of use for which the 5.31 tax-forfeited lands were acquired as provided in Minnesota 5.32 Statutes, section 282.01. 5.33 (c) The conveyance must be in a form approved by the 5.34 attorney general. 5.35 Subd. 2. [LEGAL DESCRIPTION.] (a) The parcel of land that 5.36 may be conveyed is described as: Outlot 2, Sun Valley. 6.1 (b) The land described must be sold under the sale 6.2 provisions in Minnesota Statutes, section 282.01. 6.3 (c) Hennepin County has determined that the county's land 6.4 management interests would best be served if the lands were 6.5 returned to private ownership or conveyed to a governmental 6.6 subdivision for an authorized public use. 6.7 [EFFECTIVE DATE.] This section is effective the day 6.8 following final enactment. 6.9 Sec. 8. [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 6.10 PUBLIC WATER OR INCLUDING WETLANDS; HENNEPIN COUNTY.] 6.11 Subdivision 1. [SALE REQUIREMENTS.] (a) Notwithstanding 6.12 Minnesota Statutes, sections 92.45, 103F.535, and 282.018, 6.13 subdivision 1, Hennepin County may sell or convey to the city of 6.14 Eden Prairie, a governmental subdivision, for an authorized 6.15 public use for wetland purposes, the parcel of tax-forfeited 6.16 land bordering public water or natural wetlands containing in 6.17 excess of 150 feet of frontage on Lake Idlewild (27-74P), that 6.18 is described in subdivision 2, under the remaining provisions of 6.19 Minnesota Statutes, chapter 282. 6.20 (b) Any such conveyance shall be subject to restrictions 6.21 imposed by the commissioner of the Department of Natural 6.22 Resources and subject to the clause for reversion to the state 6.23 for failure to use, or abandonment of use for which the 6.24 tax-forfeited lands were acquired as provided in Minnesota 6.25 Statutes, section 282.01. 6.26 (c) The conveyance must be in a form approved by the 6.27 attorney general. 6.28 Subd. 2. [LEGAL DESCRIPTION.] (a) The parcel of land that 6.29 may be conveyed is described as Lot 21 except parts platted as 6.30 Registered Land Survey No. 895 and Idlewood Lake Addition and 6.31 Anderson Idlewild Addition and Anderson's Idleview, Auditor's 6.32 Subdivision No. 335, Hennepin County, Minnesota. 6.33 (b) The land described must be sold under the sale 6.34 provisions in Minnesota Statutes, section 282.01. 6.35 (c) Hennepin County has determined that the county's land 6.36 management interests would best be served if the lands were 7.1 returned to private ownership or conveyed to a governmental 7.2 subdivision for an authorized public use. 7.3 [EFFECTIVE DATE.] This section is effective the day 7.4 following final enactment. 7.5 Sec. 9. [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 7.6 PUBLIC WATER OR INCLUDING WETLANDS; HENNEPIN COUNTY.] 7.7 Subdivision 1. [SALE REQUIREMENTS.] (a) Notwithstanding 7.8 Minnesota Statutes, sections 92.45, 103F.535, and 282.018, 7.9 subdivision 1, Hennepin County may sell or convey to the city of 7.10 Eden Prairie, a governmental subdivision, for an authorized 7.11 public use of wetland purposes, the parcel of tax-forfeited land 7.12 bordering public water or natural wetlands containing in excess 7.13 of 150 feet of frontage on Lake Idlewild (27-74P) or the 7.14 majority of the parcel under water, that is described in 7.15 subdivision 2, under the remaining provisions of Minnesota 7.16 Statutes, chapter 282. 7.17 (b) Any such conveyance shall be subject to restrictions 7.18 imposed by the commissioner of the Department of Natural 7.19 Resources and subject to the clause for reversion to the state 7.20 for failure to use, or abandonment of use for which the 7.21 tax-forfeited lands were acquired as provided in Minnesota 7.22 Statutes, section 282.01. 7.23 (c) The conveyance must be in a form approved by the 7.24 attorney general. 7.25 Subd. 2. [LEGAL DESCRIPTION.] (a) The parcel of land that 7.26 may be conveyed is described as Outlot A, Anderson Idlewild 7.27 Addition. 7.28 (b) The land described must be sold under the sale 7.29 provisions in Minnesota Statutes, section 282.01. 7.30 (c) Hennepin County has determined that the county's land 7.31 management interests would best be served if the lands were 7.32 returned to private ownership or conveyed to a governmental 7.33 subdivision for an authorized public use. 7.34 [EFFECTIVE DATE.] This section is effective the day 7.35 following final enactment. 7.36 Sec. 10. [PRIVATE SALE OF SURPLUS STATE LAND; HUBBARD 8.1 COUNTY.] 8.2 (a) Notwithstanding Minnesota Statutes, sections 94.09 and 8.3 94.10, the commissioner of natural resources may sell by private 8.4 sale the surplus state land that is described in paragraph (c). 8.5 (b) The conveyance must be in a form approved by the 8.6 attorney general. The attorney general may make necessary 8.7 changes to the legal description to correct errors and ensure 8.8 accuracy. 8.9 (c) The land that may be sold is located in Hubbard County 8.10 and is described as follows: 8.11 That part of the Northwest Quarter of the Northwest Quarter 8.12 of Section 22, Township 142 North, Range 33 West, Hubbard 8.13 County, Minnesota, described as follows: 8.14 Beginning at the northeast corner of said Northwest Quarter 8.15 of the Northwest Quarter, being a 3/4 inch rebar with 8.16 plastic cap stamped "MN DNR LS 17005" (DNR Monument); 8.17 thence on a bearing based on the Hubbard County Coordinate 8.18 System of 1983 of North 88 degrees 51 minutes 21 seconds 8.19 West, along the north line of said Northwest Quarter of the 8.20 Northwest Quarter 253.67 feet to a DNR Monument; thence 8.21 South 04 degrees 03 minutes 57 seconds East 132.71 feet to 8.22 a DNR Monument; thence South 79 degrees 15 minutes 13 8.23 seconds East 248.33 feet to the east line of said Northwest 8.24 Quarter of the Northwest Quarter and a DNR Monument; thence 8.25 North 00 degrees 05 minutes 06 seconds East along the east 8.26 line of said Northwest Quarter of the Northwest Quarter 8.27 173.61 feet to the point of beginning, containing 0.87 8.28 acres. 8.29 (d) The sale would resolve a long-standing unintentional 8.30 trespass. 8.31 Sec. 11. [COUNTY ENVIRONMENTAL TRUST FUND; ITASCA COUNTY.] 8.32 (a) Notwithstanding Laws 1998, chapter 389, article 16, 8.33 section 31, subdivision 4, as amended, Itasca County may spend 8.34 money in the Itasca County environmental trust fund to acquire 8.35 the land described in paragraph (b) for public access purposes. 8.36 (b) The land to be acquired by Itasca County is described 9.1 as: 9.2 (1) parcel number 91-017-1105; and 9.3 (2) parcel number 91-017-1102. 9.4 Sec. 12. [PRIVATE SALE OF TAX-FORFEITED LAND BORDERING 9.5 PUBLIC WATER; ITASCA COUNTY.] 9.6 (a) Notwithstanding Minnesota Statutes, sections 92.45 and 9.7 282.018, subdivision 1, and the public sale requirements of 9.8 Minnesota Statutes, chapter 282, Itasca County may sell by 9.9 private sale the tax-forfeited land bordering public water that 9.10 is described in paragraph (c), under Minnesota Statutes, section 9.11 282.01, subdivision 7. 9.12 (b) The conveyance must be in a form approved by the 9.13 attorney general for the appraised value of the land and include 9.14 conditions that the existing structures must be removed within 9.15 one year of the sale and a conservation easement be retained on 9.16 the parcel. 9.17 (c) The land to be sold is located in Itasca County and is 9.18 described as: Government Lot 9, Section 19, Township 60 North, 9.19 Range 26 West. 9.20 (d) The county has determined that the county's land 9.21 management interests would be best served if the lands were 9.22 returned to private ownership. 9.23 Sec. 13. [PUBLIC SALE OF TAX-FORFEITED LAND BORDERING 9.24 PUBLIC WATER; ITASCA COUNTY.] 9.25 (a) Notwithstanding Minnesota Statutes, sections 92.45 and 9.26 282.018, subdivision 1, Itasca County may sell the tax-forfeited 9.27 land described in paragraph (c) by public sale, under the 9.28 remaining provisions of Minnesota Statutes, chapter 282. 9.29 (b) The conveyance must be in a form approved by the 9.30 attorney general for the appraised value of the land. 9.31 (c) The land to be sold is located in Itasca County and is 9.32 described as: 9.33 (1) that part lying west of Highway 65 of the Northwest 9.34 Quarter of the Northeast Quarter, Section 13, Township 53 North, 9.35 Range 23 West; 9.36 (2) the undivided 1/24th interest in the Northeast Quarter 10.1 of the Southwest Quarter, Section 13, Township 56 North, Range 10.2 25 West; 10.3 (3) the undivided 1/24th interest in the Northwest Quarter 10.4 of the Northwest Quarter, Section 13, Township 56 North, Range 10.5 25 West; and 10.6 (4) the West 200 feet of the East Half of Government Lot 4, 10.7 Section 23, Township 58 North, Range 24 West. 10.8 (d) The county has determined that the county's land 10.9 management interests would be best served if the lands were 10.10 returned to private ownership. 10.11 Sec. 14. [PRIVATE SALE OF SURPLUS STATE LAND BORDERING 10.12 PUBLIC WATER; LAKE COUNTY.] 10.13 (a) Notwithstanding Minnesota Statutes, sections 92.45, 10.14 94.09, and 94.10, the commissioner of natural resources may sell 10.15 by private sale the surplus state land bordering public water 10.16 that is described in paragraph (c). 10.17 (b) The conveyance must be in a form approved by the 10.18 attorney general. The conveyance shall reserve a conservation 10.19 easement to ensure protection of the fish and wildlife shoreline 10.20 habitat. The attorney general may make necessary changes to the 10.21 legal description to correct errors and ensure accuracy. 10.22 (c) The land that may be sold is located in Lake County and 10.23 is described as follows: an undivided 1/16th interest in 10.24 Government Lot 7, Section 31, Township 63 North, Range 11 West. 10.25 (d) The sale would allow the combination of the 1/16 10.26 interest with the remaining 15/16 interest. 10.27 Sec. 15. [PRIVATE SALE OF TAX-FORFEITED LAND BORDERING 10.28 PUBLIC WATERS; RICE COUNTY.] 10.29 (a) Notwithstanding Minnesota Statutes, sections 92.45 and 10.30 282.018, subdivision 1, and the public sale provisions of 10.31 Minnesota Statutes, chapter 282, Rice County may sell by private 10.32 sale the tax-forfeited land bordering public waters described in 10.33 paragraph (c), under the remaining provisions of Minnesota 10.34 Statutes, chapter 282. 10.35 (b) The sale must be in a form approved by the attorney 10.36 general. 11.1 (c) The land to be sold is located in Rice County and is 11.2 described as: Lots 3, 4, and 5, Block 2, original plat of 11.3 Morristown (parcel #20.0331.000). 11.4 (d) The county has determined that the county's land 11.5 management interests would best be served if the lands were 11.6 returned to private ownership. 11.7 Sec. 16. [CONVEYANCE OF TAX-FORFEITED LAND BORDERING 11.8 PUBLIC WATER; RICE COUNTY.] 11.9 (a) Notwithstanding Minnesota Statutes, sections 92.45 and 11.10 282.018, subdivision 1, Rice County may convey for no 11.11 consideration to the city of Dundas the tax-forfeited land 11.12 bordering public water that is described in paragraph (c). 11.13 (b) The conveyance must be in a form approved by the 11.14 attorney general and provide that the land revert to the state 11.15 if the land is not used for a public purpose as provided in 11.16 Minnesota Statutes, section 282.01. 11.17 (c) The land to be conveyed is located in Rice County and 11.18 is described as: All that part of Block Twenty-Two (22), in the 11.19 original town, now the city of Dundas, Rice County, Minnesota, 11.20 described as follows: Beginning at a point on the Southerly 11.21 line of Hester Street, so-called, on the Easterly line of the 11.22 right-of-way of the Chicago, Great Western Railway Company; 11.23 thence running in a Southerly direction parallel with said right- 11.24 of-way, a distance of Two Hundred Twenty-Five (225) Feet; thence 11.25 Easterly parallel with Hester Street, so-called, to the banks of 11.26 the Cannon River; thence Northerly along the said river bank to 11.27 a point where it intersects with the Southerly line of Hester 11.28 Street; thence in a Westerly direction along the South line of 11.29 Hester Street, to the point of the beginning (parcel 11.30 #17.0277.000). 11.31 (d) The county has determined that the county's land 11.32 management interests would best be served if the land was 11.33 conveyed to the city of Dundas. 11.34 Sec. 17. [PRIVATE SALE OF SURPLUS STATE LAND BORDERING 11.35 PUBLIC WATER; ROSEAU COUNTY.] 11.36 (a) Notwithstanding Minnesota Statutes, sections 92.45, 12.1 94.09, 94.10, and 97A.135, subdivision 2a, the commissioner of 12.2 natural resources may sell by private sale the surplus state 12.3 land bordering public waters that is described in paragraph (c). 12.4 (b) The conveyance must be in a form approved by the 12.5 attorney general. The attorney general may make necessary 12.6 changes to the legal description to correct errors and ensure 12.7 accuracy. 12.8 (c) The land that may be sold is located in Roseau County 12.9 and is described as: The southerly 396 feet, south of the south 12.10 bank of the Roseau River, of the Southwest Quarter of the 12.11 Northeast Quarter of Section 32, in Township 163 North, Range 40 12.12 West of the Fifth Principal Meridian in Roseau County, 12.13 Minnesota. Said tract of land contains 9.29 acres, more or less. 12.14 (d) The department has determined that the public interest 12.15 is best served if the property were to be conveyed to the Roseau 12.16 River Watershed District to allow for completion of the 12.17 district's flood control management plan. 12.18 Sec. 18. [PUBLIC SALE OF TAX-FORFEITED LAND BORDERING 12.19 PUBLIC WATER; ST. LOUIS COUNTY.] 12.20 (a) Notwithstanding Minnesota Statutes, sections 92.45 and 12.21 282.018, subdivision 1, St. Louis County may sell the 12.22 tax-forfeited lands bordering public water that are described in 12.23 paragraphs (c) to (g), under the remaining provisions of 12.24 Minnesota Statutes, chapter 282. 12.25 (b) The conveyances must be in a form approved by the 12.26 attorney general. The land to be 13.26 sold is located in St. Louis County and is described as: Lot 6, 13.27 Lot 7, and Lot 8, except the easterly 50 feet, Erickson's Beach, 13.28 town of Fayal, Section 27, Township 57 North, Range 17 West. 13.29 (f) The conveyance of land under this paragraph must 13.30 contain a deed restriction that is 75 feet in width along the 13.31 shoreline. This parcel 15.6 contains 2.5 acres more or less. 15.7 (d) The sales under this section resolve unintentional 15.8 occupancy trespasses. 15.9 Sec. 20. [PUBLIC SALE OF SURPLUS STATE LAND BORDERING 15.10 PUBLIC WATER; ST. LOUIS COUNTY.] 15.11 (a) Notwithstanding Minnesota Statutes, section 92.45, the 15.12 commissioner of natural resources may sell by public sale the 15.13 surplus land bordering public water that is described in 15.14 paragraph (c). 15.15 (b) The sale must be in a form approved by the attorney 15.16 general for consideration no less than the estimated market 15.17 value of the land. The attorney general may make necessary 15.18 changes in the legal description to correct errors and ensure 15.19 accuracy. 15.20 (c) The land to be sold is located in St. Louis County and 15.21 described as: the North 10 feet of the Northeast Quarter of the 15.22 Northwest Quarter, Section 16, Township 57 North, Range 17 West, 15.23 lying east of St. Mary's Lake. 15.24 (d) The parcel described in paragraph (c) has been under 15.25 lease since 1969 in order for the adjoining owner to meet county 15.26 zoning standards and the parcel is no longer needed for natural 15.27 resources purposes. 15.28 Sec. 21. [EASEMENT ON STATE LAND BORDERING PUBLIC WATER; 18.23 WASHINGTON COUNTY.] 18.24 (a) Notwithstanding Minnesota Statutes, sections 92.45, 18.25 94.09, and 94.10, the commissioner of natural resources shall 18.26 convey an easement on land bordering public water that is 18.27 described in paragraph (c). The easement shall be issued to the 18.28 current owners of land who purchased land subject to an easement 18.29 on the property described in paragraph (c), and shall allow one 18.30 dock on the property for use by the easement holders. 18.31 (b) The conveyance must be in a form approved by the 18.32 attorney general for consideration of the easement preparation 18.33 and filing costs, and provide that the easement to a property 18.34 owner expires when the current owner conveys to another person 18.35 the property that qualified the person for the easement under 18.36 paragraph (a). The attorney general may make necessary changes 19.1 to the legal description to correct errors and ensure accuracy. 19.2 (c) The land for which an easement is conveyed is located 19.3 in Washington County and is described as: 19.4 part of Government Lot 6, Section 5, Township 29, Range 21, 19.5 being the South 45 feet lying east of the road, subject to 19.6 an easement (lot ID# 05.029.21.41.0001). 19.7 Sec. 24. [REPEALER.] 19.8 Minnesota Statutes 2004, section 84.033, subdivision 2, is 19.9 repealed.
