ARTICLE 1 - COMPASSIONATE USE ACT

Enacting the "Compassionate Use Act" to protect seriously ill patients from prosecution for using medicinal marijuana under the supervision of a physician; stating the findings and
purpose of the legislature relating to the use of marijuana in the treatment of certain debilitating illnesses and the recognition of scientific evidence on the medicinal benefits of marijuana while maintaining a strong public policy against illegal drug use

ARTICLE 2 - MEDICAL USE OF MARIJUANA

Specifying conditions for the medical use of marijuana by qualifying patients; providing
for patient registration and providing copies of written documentation by the treating physician with the commissioner of health, providing for issuance of registration certificates by the commissioner, authorizing a fee and access to registry information for official law enforcement purposes; restricting use of marijuana for medicinal purposes; establishing certain legal protections for patients, primary caregivers and physicians; providing for physician testimony in legal proceedings; protecting property used in connection with the medical use of marijuana from forfeiture; affirmative defense of the use of marijuana for medical purposes to be presumed valid in the presence of certain evidence; imposing a penalty for fraudulent representation of the medical use of marijuana; authorizing the commissioner to classify additional medical conditions as debilitating for medical marijuana use purposes, requiring the adoption of rules under certain conditions; severability clause
