A bill for an act
relating to agriculture; providing for additional
periodic payments for the taking of agricultural land
for transmission of electricity; amending Minnesota
Statutes 2004, section 116C.63, by adding a
subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2004, section 116C.63, is
amended by adding a subdivision to read:

In
eminent domain proceedings related to transmission routes for
the acquisition of real property that is homestead or
nonhomestead agricultural land that is or could be used for
farming, the acquiring utility must, in addition to any other
payments, make the payments required by this subdivision. The
utility must perpetually and annually pay royalties to the owner
of the fee or contract for deed vendee, if applicable. The
royalty must be based on the amount of electricity carried on
the lines placed on the route. The royalties do not attach to
the land but are personal property of the fee owner or contract
for deed vendee.

Section 1 is effective August 1, 2005, and applies to
condemnation awards filed on or after that date.
