1E Relating to the organization, operation and financing of state government, appropriating money for general legislative and administrative expenses and reducing certain appropriations
ARTICLE 1 - STATE GOVERNMENT APPROPRIATIONS
Reducing the general appropriation to the legislature, designating a certain amount of money to be used by the legislative coordinating commission (LCC) for the legislators forum and for the electronic real estate recording task force; reducing appropriations to the constitutional officers, appropriating a small amount of money and increasing the base appropriation to the secretary of state for challenger training costs; reducing appropriations to the amateur sports commission and to the commissioners of administration and revenue, providing a certain amount of money to the commissioner of administration for grants to assistive technology of Minnesota and to Minnesota public radio; appropriating money to the office of enterprise technology in the department of administration, to the office of administrative hearings, to the department of military affairs for operation and staffing of the national guard youth camp at Camp Ripley and for certain enlistment incentives, to the commissioner of veterans affairs for grants to certain veterans organizations, to the gambling control board, to the racing commission for certain oversight and legal costs and to the commissioner of finance for the salary supplement, specifying certain increases estimation and certification requirements of the commissioner of employee relations (DOER); requiring the commissioner of finance in consultation with the commissioner of administration to determine the savings attributable to drive to excellence for deposit in the general fund; modifying a certain general appropriations reduction requirement of the commissioner, expanding the requirement to the enterprise technology and higher education services (HESO) offices and the department of revenue and reducing the total reduction amount
ARTICLE 2 - STATE GOVERNMENT OPERATIONS
Requiring collections received from audits of the metropolitan sports facilities, airports and mosquito control commissions and the state agricultural society to be added to the appropriation for the legislative auditor; subjecting the state auditor to a certain provision requiring and regulating reports to the legislature and specifying certain duties of the state auditor relating to the acceptance of applications from local government units for the waiver of rules and procedural laws and for grants to promote cooperative public service delivery efforts, prescribing procedures; regulating public web sites maintained with public money by elected or appointed officials of state or local government agencies and authorizing the officials to use public money for publications relating to duties and jurisdiction of the office; requiring state agencies to preserve records of employees involuntarily terminated from employment for employee access purposes; prohibiting public employers from forbidding peace officers or firefighters from wearing a patch or pin depicting the American flag; modifying certain provisions regulating budget forecasts by the commissioner of finance, requiring budget plans to include recommendations to bring the state budget into compliance with generally accepted governmental accounting principles; modifying certain competitive bidding procedures for state government procurement purposes; clarifying the authority for discharge or reprimand of classified employees; prohibiting public employers from retaliating against employees reporting waste, inefficiency or mismanagement; expanding the authorized use of sick leave under the employment law to absences due to illness, injury or death of spouses, siblings, parents, grandparents, stepparents or regular members of the household; providing for Minnesota support our troops grants; authorizing the commissioner of veterans affairs to use nonexpended funds under the veterans service office grant program to provide training and education for county veterans service officers; decreasing the percentage of gross revenue allowed to be deposited in the lottery operation account; requiring the secretary of state to prepare notaries public certification application forms; modifying certain procedures for the processing of human rights complaints; limiting the amount of lease payments received by the amateur sports commission allowed to be used for commission purposes; providing for the formation of a state health care purchasing authority to implement a unified strategy and joint purchasing of health care services for the state, specifying certain plan and guidelines requirements; ratifying certain public employee labor agreements and compensation plans approved by the legislative coordinating commission (LCC) subcommittee on employee relations on certain dates; providing for state employee voluntary unpaid leaves of absence; requiring state agencies to consider using services provided by government training services before contracting with outside vendors; requiring the Minnesota historical society to request the Smithsonian institute to extend the time for displaying the portraits of Julie Finch Gilbert and Cass Gilbert in the capitol building; repealing a certain provision prohibiting the misuse of state publications by elected, administrative or executive state officers
ARTICLE 3 - ELECTRONIC REAL ESTATE RECORDING
Temporarily reestablishing the electronic real estate recording task force to study and make recommendations for the establishment and implementation of a system for the electronic filing and recording of real estate documents, specifying certain duties, requiring the task force to review the uniform electronic recording act and to submit annual progress reports to the legislature; authorizing counties participating in the original pilot project for the electronic filing of documents to continue to record or file documents electronically under certain conditions
ARTICLE 4 - OFFICE OF ENTERPRISE TECHNOLOGY
Creating the office of enterprise technology to replace the office of technology in providing oversight, leadership and direction for information and telecommunications technology policy; expanding and clarifying certain duties of the office; requiring the office to be headed by a state chief information officer to be appointed by the governor; providing for office management, structure and accountability; transferring certain duties of the commissioner of administration to the chief information officer, requiring administrative support of the commissioner; modifying certain state information and telecommunication systems administration requirements and certain requirements for state agency implementation of electronic government services; creating the enterprise technology revolving fund for use by the chief information officer to operate information and telecommunications services, specifying certain reimbursement requirements; making conforming amendments to certain statutory provisions governing certain criminal and juvenile justice information policy group and task force and statewide radio board membership; specifying certain term substitution and recodification instructions to the revisor of statutes; repealing the intertechnologies revolving fund and certain review and approval requirements of the commissioner
ARTICLE 5 - ELECTIONS
Clarifying the definition of campaign expenditure, including payments for funeral gifts or memorials; expanding the public officials gift ban exception for trinkets or mementos and excepting food or beverages at certain receptions held within the metropolitan area during legislative session from the ban on gifts by lobbyists, cost limit; changing the option for post-secondary educational institutions to prepare student residential housing lists to be sent to county auditors for use in election day registration to a requirement, providing for protection of certain information; modifying certain requirements for status as a major or minor political party; clarifying the voting rights of persons under guardianship; extending the time limit for state or local agency submittal of voter registration applications to the secretary of state or the county auditor; updating certain election day registration proof of residence requirements and authorizing the registration of students presenting a copy of a current student registration card or a current student monthly rental statement containing a valid residential address in the precinct, requiring residential facility operators to prepare lists of the names of employees and the facility address for vouching purposes and expanding the eligibility of native Americans to register on election day; modifying certain voter registration card requirements; eliminating the requirement for a court order to withhold names of registered voters from the public information list for voter safety purposes; providing for ongoing absentee voter status; requiring county auditors to mail absentee ballot applications to the study abroad offices of colleges and universities; expanding the oath requirement of election judges; expanding the requirement for the secretary of state to develop translated voting materials in languages other than English; specifying certain identification badge requirements for officials on duty in polling places; prohibiting the appointment of election judges as challengers; requiring training of polling place challengers, specifying certain duties of the secretary of state; modifying the voters bill of rights relating to the right of convicted felons to vote; providing for the right of persons under guardianship to vote unless revoked by the court; expanding the statement of grounds requirement for challenges to voters; modifying the prohibition on eligibility to vote after leaving the polling place without voting; modifying the restriction on the distribution of food or nonalcoholic beverages at private gatherings or public meetings and expanding the provision to public parades; requiring and providing for county sheriffs or jailers voting assistance to inmates
ARTICLE 6 - UNCLASSIFIED POSITIONS
Eliminating the positions of deputy commissioner and assistant commissioner in state departments and agencies
ARTICLE 7 - LICENSURE AND SALES OF MANUFACTURED AND INDUSTRIALIZED MODULAR HOMES
Requiring and providing for the licensure of manufactured and industrialized/modular home salespersons and brokers by the commissioner of administration, requiring the licensing of industrialized/modular home dealers as manufactured home dealers, residential contractors or real estate brokers; specifying license and examination requirements for salespersons or brokers and providing for application; requiring and providing for commissioner issuance of provisional license upon application before examination; specifying certain continuing education requirements; specifying the duration of license validity, providing for renewal; requiring cancellation of licenses for failure to complete continuing education requirements; providing for license issuance, specifying the responsibility of employers; providing for license terminations and transfers and for temporary dealers licenses under certain conditions; specifying certain license exemptions; authorizing the commissioner to set initial fees
