3E Relating to human services, modifying certain provisions relating to children and family services and health and continuing care programs

ARTICLE 1 - CHILDREN'S AND FAMILY SERVICES

Making certain technical modifications; providing for the classification of data on individuals receiving services under certain community action and foodshelf programs administered by the department of human services, transferring the classifications from the department of education; modifying a certain household income eligibility requirement for child care assistance; increasing the transitional standard and the food portion under the Minnesota family investment program; eliminating a certain requirement under MFIP for exemption of participants with children under a certain age from the requirement to participate in employment services and the requirement for the commissioner of human services to include cases exempt from the employment and training service component in quarterly reports to counties; modifying the definition of family unit and defining caregiver under the diversionary work program; requiring counties to screen and applicants to apply for other benefits; further restricting a certain exemption to the requirement for DWP participation; modifying the MFIP disqualification period for noncompliance with DWP
requirements; modifying the determination of DWP overpayments and underpayment; modifying the use of federal funds received by the commissioner for visitation and access programs; specifying certain term change, codification or recodification and renumbering instructions to the revisor of statutes

ARTICLE 2 - HEALTH CARE AND CONTINUING CARE

Specifying the effect of rate changes under medical assistance (MA), general assistance (GA) and MinnesotaCare on volume purchase contract payments; requiring the commissioner of human services to annually adjust income standards or limits under medical assistance, general assistance medical care (GAMC) and MinnesotaCare by the annual update of the federal poverty guidelines; eliminating certain restrictions on medical assistance coverage for organ and tissue transplants; modifying certain provisions providing for payment for long
term care consultation services relating to county accountability; modifying the required use of the county waiting list of persons with developmental disabilities; clarifying the exclusion from child welfare targeted case management services payments of certain information and referral services; requiring children's therapeutic services and supports (CTSS) certified provider entities providing day treatment programs to meet certain conditions and modifying the requirement for provider entities to employ clinical supervisors for mental health behavioral aides; eliminating the requirement for certain rules of the commissioner to be in accord with the community social services act (CSSA); eliminating dependent siblings from the definition of family with children under the MinnesotaCare program; requiring county social service agencies to maintain private data on individuals under the child maltreatment reporting act without the necessity to prepare investigative memoranda; repealing a certain purpose statement under department of education programs relating to improving the well being of children and families, the abused child program, a certain advisory council, the child care services grants statewide advisory task force, a certain commissioner state and county systems reporting requirement, a certain final order requirement in the child care services fair hearing process, the organ and tissue transplants advisory committee and certain responsibilities of the commissioner and a certain law requiring a commissioner consumer price index report

ARTICLE 3 - MISCELLANEOUS

Eliminating certain references to the adult and children's mental health
components of the community social services plan under the adult and children's mental health acts and certain other references to the CSSA under certain provisions regulating county and private agencies performing licensing functions, commissioner of human services allocation of day training and habilitation expenditure payments, human services matters administrative and judicial review, unitary residence and financial responsibility program coverage and multidisciplinary adult protection team duties under the vulnerable adult maltreatment reporting act; requiring the inclusion of continuous quality improvement goals under local system needs planning for intermediate care facilities for persons with mental retardation and related conditions (ICF/MR); correcting a certain date under certain community service plan requirements;
specifying certain change instructions to the revisor of statutes; repealing
certain provisions relating to the allocation of certain federal mental health
services funds, certain social services reporting requirements of the
commissioner and the county community social service plan for alternative
response programs for child protection assessments or investigations under the child maltreatment reporting act
