SF 1716 Senate Long Description

Modifying certain workers compensation provisions, adopting recommendations of the workers compensation advisory council; modifying the definition of employee relating to voluntary uncompensated workers; excluding employees hired by North Dakota employers resulting from temporary work in Minnesota from coverage, defining temporary work; eliminating the requirement for insurers and self insured employers to file annual statements with the commissioner of labor and industry detailing the total amount of legal fees and costs incurred during the year; making the presumption of parent as guardian specific to minor employees; requiring the deposit of certain penalties in the assigned risk safety account in lieu of the special compensation fund; granting the commissioner jurisdiction to hold administrative conferences and issue decisions and orders in rehabilitation disputes involving treatment and medical fees; modifying the definitions of paid indemnity losses and standard workers compensation premium for special compensation fund purposes and certain requirements for payments to the fund, authorizing the commissioner to allow offset of certain reimbursements due employers or insurers; authorizing employers to designate pharmacies or pharmacy networks for required use by employees to obtain outpatient medications, restriction, authorizing contracts; authorizing electronic submission of health care provider bills; expanding certain collective bargaining agreement validity recognition requirements; modifying certain policy cancellation, termination or nonrenewal notice requirements; specifying the liability of employers for payment of compensable workers compensation claims upon insurer insolvency and certain related notice requirements of the insurance guaranty association, requiring payment by the association under certain employer failure to pay conditions or a commissioner of commerce requirement for employer contracts with licensed third party administrators, requiring employer reports and assessment payments to and providing for employer requests for supplementary benefits and second injury reimbursement from the special compensation fund under certain conditions; eliminating the requirement for the first report of injury form to include a certain declaration relating to employer compensation payment and the requirement for the commissioner of labor and industry to establish a list of neutral physicians or surgeons for appointment purposes
