SF 1313 Senate Long Description

Providing for the organization, operation and financing of state government, modifying certain health and human services provisions

ARTICLE 1 - LICENSING

Imposing an annual license fee on home and community based waiver residential based habilitation services for persons with developmental disabilities, exempting state operated programs; increasing the fee for the cost of background studies initiated by supplemental nursing services agencies and personal care provider organizations and increasing the limit on the fee for the cost of obtaining and providing requested background study data

ARTICLE 2 - STATE OPERATED SERVICES

Modifying certain provisions relating to adult mental health service delivery pilot projects, authorizing certain enterprise activities and additional Minnesota security hospital geographic locations; authorizing the commissioner of human services to vacate and close regional treatment center and state operated nursing home programs and campuses under certain conditions

ARTICLE 3 - HEALTH CARE

Providing for the transfer of certain revenues to the health care access fund, limits; designating the MinnesotaCare program as a forecasted program for certain fiscal years, providing for the meeting of expenditures; authorizing test sites for the medical assistance (MA), general assistance medical care and MinnesotaCare programs; authorizing counties to recover certain MinnesotaCare costs; authorizing state agency hearings for adverse decisions relating to medicare part D prescription drug subsidies; authorizing the department of human services to initiate administrative fraud disqualification hearings in certain cases; authorizing and providing for department withholding for delinquent provider surcharges; reducing the payment for fee for service inpatient and outpatient hospital admissions, excluding inpatient mental health services; requiring the commissioner of human services to administer eligibility determinations for the medicare part D prescription drug subsidy and facilitate the enrollment of eligible medical assistance recipients into medicare prescription drug plans; limiting reasonable expenses for institutionalized persons for medical assistance eligibility determination purposes; clarifying the period of ineligibility for certain uncompensated transfers; requiring and providing for the commissioner to establish a medical policy committee to advise on medical issues relating to the administration of state health care programs; eliminating medical assistance coverage of drugs coverable under medicare part D after a certain date; modifying certain provisions governing the drug utilization review board and the formulary committee; modifying the method for commissioner estimation of the actual acquisition costs of drugs and the basis for determining the amount of payment under medical assistance for drugs administered in outpatient settings, authorizing the commissioner to negotiate lower reimbursement rates for specialty pharmacy products; authorizing the commissioner to automatically require prior authorization for drugs approved by the federal food and drug administration (FDA), providing for certain formulary committee recommendations; reducing the total payment made to managed care plans under the medical assistance and GAMC prepayment demonstration projects, exclusions; modifying certain GAMC eligibility provisions; requiring GAMC payments after a certain date to be from the health care access fund; eliminating eligibility under the MinnesotaCare program for single adults and households without children and modifying certain other eligibility requirements; reducing the total payments made to managed care plans under the program; providing for the recovery of medical assistance from certain trusts and annuities; requiring the commissioner to develop recommendations to simplify publicly funded heath care program financing and report to the legislature; repealing the senior citizens prescription drug program and the prohibition on nonMinnesotaCare transfers from the health care access fund

ARTICLE 4 - NURSING FACILITY REIMBURSEMENT

Modifying a certain provision regulating nursing facility bed layaways and delicensure; requiring an increase in nursing facility case mix payment rates; modifying the definition of nursing facility for long term care facilities central, affiliated or corporate office costs allocation purposes, providing for the allocation of certain costs on a functional basis, authorizing nursing facilities to assign certain remaining costs to the appropriate cost category for a limited period of time and authorizing inclusion of certain organization costs; extending the duration of contracts under the alternative payment demonstration project and providing for the phase out of the contracts; requiring and providing for the commissioner of human services to establish a value based nursing facility reimbursement system to provide facility specific prospective rates for nursing facilities participating in the medical assistance (MA) program

ARTICLE 5 - CHILDREN AND FAMILIES

Modifying certain child care assistance subsidy restrictions; authorizing and providing for the commissioner of human services to authorize projects to test tribal delivery of child welfare services to American Indian children, parents and custodians living on reservations; specifying the standard of assistance for general assistance (GA) recipients residing in the state for a certain short period of time and modifying certain interim assistance agreement provisions, authorizing commissioner contracts for advocacy and support services to process claims for federal disability benefits for applicants or recipients of services or benefits supervised by the commissioner, specifying a certain recoveries limit; imposing a residency requirement for diversionary work program applicants under the Minnesota family investment program and providing for the calculation of assistance paid to eligible DWP family units residing in the state for a certain short period of time, providing for the application of certain interstate payment standards; requiring and providing for the commissioner to establish a long term homeless supportive services fund to provide integrated services needed to stabilize individuals, families and youth living in supportive housing; repealing a certain provision providing for continuation of certain child care payment rates, the interim assistance advocacy incentive program under general assistance and certain rules requiring screening of general assistance applicants or recipients for eligibility for other maintenance benefits and certain special services for SSI applicants

ARTICLE 6 - MISCELLANEOUS

Requiring the commissioner of human services to authorize the method of payment to or from the department as a part of the human services programs administered by the department; requiring the deposit of child support collections in the general fund, repealing the special revenue account for child support collections

ARTICLE 7 - HEALTH POLICY

Increasing the fee charged by the commissioner of health for variance requests relating to wells and borings; increasing certain well notification, permit and disclosure certificate fees; changing exploratory borers licenses to explorers licenses and setting certain fees; increasing hospital, nursing home and outpatient surgical center license fees; expanding eligibility under the health professional education loan forgiveness program to dentists; increasing or imposing certain vital records processing, public water supply connection and environmental labs certification fees; providing for positive abortion alternatives, specifying certain duties of the commissioner; restricting the authority of the commissioner to establish suicide prevention programs to the availability of appropriated funds; imposing a statewide hospitality fee to fund statewide food, beverage and lodging program development activities and increasing or imposing certain food and beverage establishment fees or penalties; clarifying certain food and beverage establishments inspection frequency requirements and providing for the inspection of school food service establishments; requiring the commissioner to amend certain rules for certified food manager fee conformity purposes; repealing the dentists loan forgiveness program, the office of complementary and alternative health care practices and the regulated food and the beverage service establishment industry pilot project

ARTICLE 8 - APPROPRIATIONS

Appropriating money to the commissioner of human services for agency management, for revenue and pass through expenditures, for children and economic assistance, basic health care and continuing care grants and management and for state operated services, to the commissioner of health for community and family health promotion, for policy quality and compliance, for health protection, for minority and multicultural health and for administrative support services, to the veterans nursing homes,
health related licensing and emergency medical services (EMS) boards, to the council on disability and to the ombudsman for mental health and mental retardation and for families; regulating certain expenditures by the commissioner of human services and specifying certain TANF (temporary assistance for needy families) maintenance of effort (MOE) requirements; providing for certain fund transfers; prohibiting the commissioners of health and human services from using indirect cost allocations to pay for program operational costs; sunsetting uncodified language
