A bill for an act
relating to vocational rehabilitation; providing for affirmative-business enterprise
employment; proposing coding for new law in Minnesota Statutes, chapter 268A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.

[268A.16] AFFIRMATIVE-BUSINESS ENTERPRISE
EMPLOYMENT.

"Affirmative-business enterprise employment" means
employment that provides paid work on the premises of an affirmative-business
enterprise certified by the commissioner of employment and economic development.
An affirmative-business enterprise must:

(1) employ no more than 40 percent of workers with severe disabilities;

new text begin
(2) report individual work in an integrated setting, as defined in Code of Federal
Regulations, title 34, section 361.5, paragraph (b)(33)(ii);

(3) pay individuals at or above minimum wage; and
new text end
new text begin
(4) provide a benefit package that is available to all employees.

Affirmative-business enterprise
employment is community employment for purposes of funding under Minnesota Rules,
parts 3300.2005 to 3300.2055.
