Relating to the financing of education and human services programs

ARTICLE 1 - PREKINDERGARTEN THROUGH GRADE 12 EDUCATION

Making forecast adjustments to certain prior appropriations to the commissioner of education for general education, referendum tax base replacement, abatement, nonpublic pupil education and transportation, charter school building lease, integration and magnet school start up, tribal contract school, special education, children with disabilities, teacher travel for home based services and special education excess cost, health and safety, debt service equalization, alternative facilities bonding, school lunch, traditional school breakfast, regional library telecommunications, early childhood family education (ECFE), health and developmental screening, community education, adults with disabilities program, extended day care and adult basic education (ABE) aids, for consolidating school districts, for interdistrict desegregation or integration transportation, American Indian success for the future and regional library basic system support grants, for special education litigation costs, for court placed special education revenue and out of state tuition, for multicounty multitype library systems, for the electronic library for Minnesota and for school readiness programs

ARTICLE 2 - HUMAN SERVICES FORECAST ADJUSTMENTS

Making forecast adjustments to certain appropriations to the commissioner of human services for revenue and pass through expenditures, for basic health and continuing care and economic support grants and child care

ARTICLE 3 - HUMAN SERVICES SAVINGS

Clarifying the period of ineligibility for long term care services under medical assistance (MA) for certain uncompensated transfers; requiring and providing for the commissioner of human services to establish a health services policy committee for advice on services relating to the administration of health care benefits under the medical assistance, general assistance medical care (GAMC) and MinnesotaCare programs, specifying certain membership requirements; providing for the acquisition cost of antihemophilic factor drugs and modifying the basis for determining the amount of payment for drugs administered in outpatient settings for medical assistance payment rate determination purposes, authorizing the commissioner to negotiate lower reimbursement rates for specialty pharmacy products and to require individuals enrolled in health care programs administered by the department to obtain specialty pharmacy products from providers agreeing to the lower rates, defining specialty pharmacy products and requiring the commissioner to consult with the formulary committee to develop a list of the products; authorizing the commissioner to automatically require prior authorization for the coverage of drugs under medical assistance for drugs approved by the federal food and drug administration (FDA) after a certain date, imposing a time limit, requiring the formulary committee to recommend to the commissioner general criteria to be used for prior authorization; providing for the recovery of medical assistance costs for long term care services from certain trusts or similar legal instruments; requiring the commissioner to temporarily limit the new diversion caseload growth in the MR/RC waiver, requiring the award of available diversion allocations to support individuals with health and safety needs resulting in imminent risk of institutional placement and the availability of additional allocations for certain community alternatives for disabled individuals (CADI) and traumatic brain injury waivered services, specifying certain priorities
