Relating to the organization, operation and financing of state government, appropriating money for general legislative and administrative expenses

ARTICLE 1 - STATE GOVERNMENT APPROPRIATIONS

Appropriating money to the legislature for general operations, providing separate appropriations to the senate and house of representatives and to the legislative coordinating commission for broadcast services, for the offices of the revisor of statutes and the legislative auditor and for the legislative reference library (LRL), to the constitutional officers, to the campaign finance and public disclosure, investment, capital area architectural and planning (CAAPB), gambling control and state lottery boards, to the offices of enterprise technology and administrative hearings, to the commissioner of administration for certain state facilities, state and community and administrative management services, for a grant to assistive technology to administer a microloan program for people with disabilities, for the developmental disabilities council and for public television and radio and Twin Cities regional cable channel grants, to the commissioner of finance for state financial management and information and management services, to the commissioner of employee relations (DOER), to the commissioner of revenue for tax system and accounts receivable management, to the department of military affairs for training facilities maintenance, for the camp Ripley youth camp, for general support and for certain enlistment incentives, to the commissioner of veterans affairs for services provided by the veterans of foreign wars, the military order of the purple heart, the disabled American veterans and the Vietnam veterans of America, for grants for certain other veterans services and for an outreach and assistance initiative for underserved veterans, to the commissioner of public safety for the costs of issuing the support our troops license plates, to the racing and amateur sports commissions, to the black Minnesotans, Chicano/Latino affairs, Asian-Pacific Minnesotans and Indian affairs councils, to the Minnesota state retirement system (MSRS) and to the teachers retirement (TRA) and Minneapolis employees retirement (MERF) funds; providing for the payment of tort claims and for certain general contingent accounts; requiring certain fund transfers or cancellations and certain carryforwards; requiring the LCC to study and report to the legislature on matters relating to the economic status of women in the state and on the adequacy of programs and services to families and to coordinate efforts to provide wireless internet service in the capitol and state office (SOB) buildings; requiring the office of the governor to inform the legislature before initiating interagency agreements; requiring the commissioner of finance to determine the savings attributable to the drive to excellence for deposit in the general fund; requiring the commissioner of revenue to report to the legislature on certain performance indicators and to develop recommendations for consolidating and coordinating debt collection; appropriating an additional amount of money to the racing commission to defray the regulatory oversight and legal costs associated with a certain license approval, regulating certain racing commission expenditures and imposing a certain hiring restriction on the commission

ARTICLE 2 - STATE GOVERNMENT OPERATIONS

Authorizing the secretary of state to sell intellectual property rights associated with the statewide voter registration system to other states, requiring deposit of receipts into the help America vote act account; subjecting the state auditor to a certain provision requiring and regulating reports to the legislature; authorizing counties, cities, towns or school districts to file resolutions with the state auditor objecting to state mandates and recommending state mandate reform, requiring the auditor to list on the web site mandates cited and the local unit citing the mandate; authorizing and providing for local government unit services delivery rule and law waiver requests to the state auditor; restricting certain attorney general legal services contracts; regulating public web sites and publications; classifying certain investment related data of the board of investment; requiring and providing for state agencies determination of certain proposed rules compliance cost thresholds and requiring legislative approval of costs exceeding the thresholds, exceptions, providing for rule waivers under certain conditions; lessening the restriction on state employee purchase of motor vehicles at auction; prohibiting public employers from forbidding peace officers or firefighters from wearing American flag patches or pins, authorizing certain restrictions; requiring the commissioner of finance to biennially report on programs projected to exceed forecasts by more than a certain percentage and modifying and clarifying certain budget forecast and money allocation requirements of the commissioner; expanding the authorized use of legislative carryforward funds; prohibiting state agencies from selling or transferring state property for less than the appraised or fair market value, exceptions; providing for selection of a primary designer in case of a tie vote by the designer selection board; specifying certain state agency larger contract or purchase cost benefit analysis requirements; eliminating the authority of the commissioner of administration to use the reverse auction procedure for engineering design services; authorizing and providing for the commissioner to use energy forward pricing mechanisms for budget risk reduction under certain conditions, requiring the development of policies and procedures for use; modifying the guaranteed energy savings program and eliminating the expiration date; requiring the commissioner to encourage small businesses to submit bids for master contracts; authorizing the commissioner to sell surplus guns to the state troopers using the guns in the course of employment; modifying certain competitive bidding procedures for state government procurement purposes; providing for the issuance of special support our troops motor vehicle license
plates to owners of passenger automobiles, pickup trucks, recreational vehicles or motorcycles to fund certain grants; providing an exception to the exemption from ad valorem taxes for land leased by the amateur sports commission, requiring legislative review of leases of certain land adjacent to the national sports center in Blaine, limiting the amount of payments received for lease of the land authorized to be used for amateur sports purposes and requiring commission annual financial reports to the legislature detailing the revenue received from individual lessees and costs incurred for maintenance and operation of leased property; authorizing and providing for the commissioner of iron range resources and rehabilitation in consultation with the commissioner of employee relations (DOER) to offer a targeted early separation incentive program for certain IRRRB employees; decreasing the percentage of gross revenue allowed to be deposited in the lottery operations account; requiring the secretary of state to prepare notaries public certification application forms; requiring certain local government units to develop policies controlling out of state travel by elected officials; requiring cities or counties over a certain population to annually notify residents of the positions and base salaries of the three highest paid employees; authorizing counties participating in the pilot project for the electronic filing of real estate documents to continue electronic recording or filing upon compliance with standards adopted by the real estate documents electronic filing task force and authorizing additional county participation under certain conditions, temporarily reestablishing the electronic real estate recording task force to study and make recommendations for implementation of a system for the electronic filing and recording of real estate documents; authorizing the commissioner of administration to enter into a lease with a private tenant for use of a certain state owned building in the city of St. Paul as a child care and after school activity facility; requiring and regulating the sale of a certain amount of state owned land; delaying the demolition of the Ford building and requiring the commissioner to report to the legislature by a certain date with recommendations for potential means and costs of preserving and using the building; requiring the commissioner of employee relations in consultation with certain other commissioners and the Minnesota comprehensive health association (MCHA) board of directors to by a certain date enter into interagency agreements for formation of the Minnesota health care purchasing authority to implement a unified strategy and joint purchasing of health care services for the state; requiring the executive branch agencies to consider using services provided by government training services before contracting with outside vendors; requiring the director of the legislative coordinating commission (LCC) to provide administrative support to a working group to study issues relating to the collection of delinquent water and sewer bills; requiring the CAAPB in consultation with the Minnesota historical society to request the Smithsonian institution to extend the period for displaying the portraits of Julie Finch Gilbert and Cass Gilbert in the capitol building; requiring the commissioner of administration to establish a memorials on the state capitol grounds honoring Coya Knutson; repealing the legislative commission on the economic status of women, the expiration date for certain restrictions on the use of proceeds from litigations or settlements, the requirement for commissioner of finance approval of state agency applications for nonstate funds and certain provisions regulating certain use of state or local government unit publications

ARTICLE 3 - PUBLIC EMPLOYMENT

Expanding the authority of the commissioner of employee relations (DOER) to contract for health insurance benefit plans; eliminating certain obsolete provisions; creating a postretirement employment option for certain state executive branch, Minnesota state retirement system (MSRS), legislative auditor office or metropolitan council employees; providing for voluntary reduction of work hours and for unpaid leaves of absence for state employees; ratifying certain labor agreements and compensation plans approved by the legislative coordinating commission (LCC) subcommittee on employee relations on certain dates

ARTICLE 4 - MILITARY AND VETERANS

Authorizing the adjutant general to rent buildings or other facilities at Camp Ripley subject to prohibitions or restrictions in agreements between the federal government and the state, prohibiting conflict with use of the camp for military purposes; authorizing the commander in chief or the adjutant general to authorize higher pay and allowances for retired national guard members upon reinstatement to temporary active service; clarifying entitlement to vacation and sick leave by public officers and employees reinstated to public office or employment after military leave; extending the eligibility of certain members of the national guard serving honorably in and separated or discharged from active service for the tuition and textbook reimbursement grant program and exempting persons separated from the national guard due to medical condition or financial hardship from a certain provision authorizing the adjutant general to recoup certain reimbursement grants; expanding the restriction on armory board membership from military officers to military personnel and allowing senior members rather than only officers of organizations using armory drill halls to be in control; authorizing the commissioner of veterans affairs to use unexpended funds from the veterans service office grant program for training and education for county veterans service officers; extending the expiration date for a certain provision providing for the purchase of prior uncredited service credit in the Minnesota state retirement system (MSRS) by certain state employees performing service in the armed forces; authorizing the placement of a memorial plaque in the court of honor on the capitol grounds recognizing the valiant service of members of the armed forces during the Persian Gulf war; repealing the provision prohibiting the use of the veterans preference credit for state or local government employment purposes by veterans currently receiving or eligible to receive a monthly veterans pension based exclusively on length of military service

ARTICLE 5 - OFFICE OF ENTERPRISE TECHNOLOGY

Creating the office of enterprise technology to replace the office of technology in providing oversight, leadership and direction for information and telecommunications technology policy; expanding and clarifying certain duties of the office; requiring the office to be headed by a state chief information officer to be appointed by the governor; providing for office management, structure and accountability; transferring certain duties of the commissioner of administration to the chief information officer, requiring administrative support of the commissioner; modifying certain state information and telecommunication systems administration requirements and certain requirements for state agency implementation of electronic government services; creating the enterprise technology revolving fund for use by the chief information officer to operate information and telecommunications services, specifying certain reimbursement requirements; making conforming amendments to certain statutory provisions governing certain criminal and juvenile justice information policy group and task force and statewide radio board membership; specifying certain term substitution and recodification instructions to the revisor of statutes; repealing the intertechnologies revolving fund and certain review and approval requirements of the commissioner

ARTICLE 6 - ELECTIONS AND CAMPAIGN FINANCE

Modifying the definitions of associated business and noncampaign disbursement for election campaign finance purposes; authorizing electronic filing of required reports or statements; modifying the exception to the gift ban for trinkets or mementos; requiring the state campaign finance and public disclosure board to send additional notices to public officials representing clients for a fee and failing to disclose the participation within a certain number of days after the first notice of subjection to a civil penalty and subjecting officials failing to respond after a second notice to the penalty; providing for electronic filing of preelection reports; expanding the prohibition on certain contributions to candidates to lobbyists and political party units; clarifying the civil penalty for exceeding contribution limits; reducing the appropriation from the general fund from the income tax checkoff for transfer to the general account of the state elections campaign fund and modifying the allocation of money in the general account to state committees of political parties, requiring allocation of certain amounts to the office of the state senator and representative; modifying the definitions of major and minor political party and defining metropolitan area under the Minnesota election law; clarifying the voting rights of persons under guardianship and of convicted felons; providing for proof of residence in residential facilities for election day voter registration vouching purposes, requiring residential facility operators to prepare lists of the names of employees and the address, regulating vouching oaths, expanding the eligibility of native Americans to register on election day and eliminating the record maintenance requirement; requiring acceptance as valid of federal postcard application forms for registration purposes; eliminating the requirement for a court order to withhold names of registered voters from public information lists for voter safety purposes and authorizing electronic requests for copies of the lists; modifying and clarifying certain absentee voting requirements and providing for ongoing absentee voter status; modifying and clarifying certain general election provisions; clarifying certain affidavit of candidacy requirements for candidates for federal office; clarifying and expanding certain polling place equipment requirements; expanding the oath requirement for election judges; modifying the requirement for the secretary of state to transmit blank forms to county auditors; specifying a certain identification badge requirement for officials on duty in polling places and a certain residency requirement for challengers, prohibiting the appointment of election judges as challengers; expanding the statement of grounds requirement for challenges to voters and certain summary statement and county auditor recordkeeping requirements; restricting the election day postelection security and certification review to elections for president, senator or representative in congress and constitutional and legislative officers; eliminating the state primary for municipalities or counties with no partisan or nonpartisan offices under certain conditions; clarifying certain uncontested judicial office ballot requirements; requiring secretary of state preparation of notices of nomination for special primary elections; delaying the deadline for the use of voting systems for disabled voters in county, municipal and school district elections; modifying the procedure for the casting of ballots by presidential electors; modifying the restriction on the distribution of food or nonalcoholic beverages at private gatherings or public meetings; clarifying the gift ban for Hennepin county officials; modifying certain affidavit of candidacy filing requirements for hospital district elections; repealing the expiration date for postelection security and certification review requirements and certain obsolete rules
