  1.1                          A bill for an act 
  1.2             relating to retirement; unclassified state employees 
  1.3             retirement program of the Minnesota State Retirement 
  1.4             System; permitting a posthumous coverage transfer 
  1.5             election in certain cases. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [MSRS-UNCLASSIFIED PROGRAM; ELECTION BY 
  1.8   SURVIVOR.] 
  1.9      (a) Notwithstanding any provision of Minnesota Statutes, 
  1.10  chapters 352 or 352D, to the contrary, a person described in 
  1.11  paragraph (b) may make the posthumous coverage election 
  1.12  specified in paragraph (c) and be eligible for the survivor 
  1.13  benefit specified in paragraph (d). 
  1.14     (b) An eligible person is the personal representative of 
  1.15  the estate of a person who: 
  1.16     (1) was born on March 26, 1942; 
  1.17     (2) was employed by the house of representatives for 
  1.18  several years prior to being laid off; 
  1.19     (3) was covered by the unclassified state employees 
  1.20  retirement program of the Minnesota State Retirement System as a 
  1.21  house employee until electing alternative coverage by the 
  1.22  general employee retirement plan at or prior to the termination 
  1.23  of house employment; 
  1.24     (4) was employed by the senate prior to death, but did not 
  1.25  make the election to transfer prior service contributions to the 
  2.1   unclassified state employees retirement program under Minnesota 
  2.2   Statutes, section 352D.12; and 
  2.3      (5) died on February 19, 2004. 
  2.4      (c) The posthumous coverage election is the transfer 
  2.5   election under Minnesota Statutes, section 352D.12, and the 
  2.6   personal representative of the estate of a person described in 
  2.7   paragraph (b) may make the election as if the representative was 
  2.8   a participant in the unclassified program. 
  2.9      (d) If the posthumous coverage election is made under 
  2.10  paragraph (c), the estate is entitled to a death benefit under 
  2.11  Minnesota Statutes, section 352D.075. 
  2.12     (e) The posthumous coverage election under this section 
  2.13  expires on July 1, 2005. 
  2.14     Sec. 2.  [EFFECTIVE DATE.] 
  2.15     Section 1 is effective the day following final enactment.
