  1.1                          A bill for an act 
  1.2             relating to health; providing title protection for 
  1.3             exercise physiologists; authorizing rulemaking; 
  1.4             providing penalties; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 148. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [148.7901] [DEFINITION.] 
  1.8      For the purposes of sections 148.7903 to 148.7909, "board"  
  1.9   means the Board of Medical Practice or its designee. 
  1.10     Sec. 2.  [148.7903] [REGISTRATION.] 
  1.11     Beginning January 1, 2005, the board may grant registration 
  1.12  as an exercise physiologist to an applicant who: 
  1.13     (1) submits an application on forms approved by the board; 
  1.14     (2) pays a fee of $.......; 
  1.15     (3) has successfully completed the national certification 
  1.16  examination administered by, and been certified as an exercise 
  1.17  physiologist by, the American Society of Exercise Physiologists 
  1.18  or a successor agency as approved by the board. 
  1.19     Sec. 3.  [148.7905] [DESIGNATION; PENALTY.] 
  1.20     (a) Only a person who is registered under section 148.7903 
  1.21  may, in the conduct of an occupation or profession pertaining to 
  1.22  the practice of exercise physiology or in connection with the 
  1.23  person's name: 
  1.24     (1) use the words or letters "registered exercise 
  1.25  physiologist"; 
  2.1      (2) use the words or letters "Minnesota registered exercise 
  2.2   physiologist"; or 
  2.3      (3) use any other words, letters, abbreviations, or 
  2.4   insignia indicating or implying that a person is an exercise 
  2.5   physiologist. 
  2.6      (b) A person who violates this section is guilty of a 
  2.7   misdemeanor and subject to discipline. 
  2.8      Sec. 4.  [148.7907] [REGISTRATION EXPIRATION AND RENEWAL.] 
  2.9      (a) Registrations issued under section 148.7905 expire 
  2.10  annually.  To be eligible for renewal, an applicant must: 
  2.11     (1) annually, or as determined by the board, complete a 
  2.12  renewal application on a form provided by the board; 
  2.13     (2) submit a renewal fee of $.......; 
  2.14     (3) provide documentation of current certification as an 
  2.15  exercise physiologist from the American Society of Exercise 
  2.16  Physiologists or a successor agency as approved by the board; 
  2.17  and 
  2.18     (4)  submit any additional information requested by the 
  2.19  board to clarify information presented in the renewal 
  2.20  application within 30 days after the board's request. 
  2.21     (b) At least 30 days before the registration renewal date, 
  2.22  the board shall send out a renewal notice to the last known 
  2.23  address of the registrant.  The notice must include a renewal 
  2.24  application and a notice of fees required for renewal.  If the 
  2.25  registrant does not receive a renewal notice, the registrant 
  2.26  must still meet the requirements for registration renewal under 
  2.27  this section. 
  2.28     (c) The renewal application and fee must be postmarked on 
  2.29  or before June 30 or as determined by the board. 
  2.30     Sec. 5.  [148.7909] [RULES.] 
  2.31     The board may adopt rules to implement sections 148.7901 to 
  2.32  148.7911. 
  2.33     Sec. 6.  [148.7911] [DISCIPLINE; REPORTING.] 
  2.34     For purposes of sections 148.7901 to 148.7907, registered 
  2.35  exercise physiologists are subject to the provisions of sections 
  2.36  147.091 to 147.162.
