Enacting a model postconviction DNA analysis act, providing +procedures for certain persons convicted of crimes to establish innocence by +petitioning the court after conviction for DNA (deoxyribonucleic acid) analysis; +requiring and providing for full, fair and prompt proceedings upon the filing of a +motion for postconviction DNA analysis in the district court in the county of +conviction; requiring the court to order testing under certain conditions; +providing for counsel for petitioners, for court discovery orders and for +preservation of physical or biological evidence; specifying certain requirements for +choosing a laboratory and providing for the payment of costs; granting +petitioners the right to appeal decisions denying postconviction DNA analysis; +authorizing certain additional court orders; prescribing a procedure for handling+ analysis results, providing for relief orders in cases favorable to the +petitioner and for dismissal of the petition in unfavorable cases; authorizing +postconviction DNA analysis upon agreement of the parties without a petition; +repealing a certain provision providing for motions for fingerprint or forensic +testing (mk)
