ARTICLE 1 Relating to crime prevention, adopting a new compact for juveniles ARTICLE I � NEW INTERSTATE COMPACT FOR JUVENILES; ADVISORY COUNCIL; +COMPACT ADMINISTRATOR; APPROPRIATIONStating the purpose of the compact and the responsibility of +compacting states to supervise or return juveniles on probation or parole absconding, +escaping or running away from supervision and control, providing for joint and +cooperative action ARTICLE II � DEFINITIONS Defining certain terms relating to the compact including compact +administrator and compacting state and certain terms relating to juvenile +delinquents or offenders ARTICLE III � INTERSTATE COMMISSION FOR JUVENILES Creating the interstate commission for juveniles under the compact, +specifying membership requirements and responsibilities, requiring establishment+ of an executive committee to act on behalf of the commission in the interim+ between commission sessions; prescribing commission member voting rights; +requiring public availability of records; authorizing closed meetings under +certain conditions; specifying certain data collection and reporting +requirements ARTICLE IV � POWERS AND DUTIES OF THE INTERSTATE COMMISSIONSpecifying certain powers and duties of the commission, requiring +coordination of education, training and public awareness relating to the +interstate movement of juveniles for officials involved ARTICLE V � ORGANIZATION AND OPERATION OF THE INTERSTATE COMMISSIONRequiring and providing for commission adoption of bylaws, election +of officers and appointment of staff; granting the executive director and +employees immunity from liability, requiring indemnification ARTICLE VI- RULEMAKING FUNCTIONS OF THE INTERSTATE COMMISSION Requiring and providing for the interstate commission to adopt and +publish rules to achieve the purposes of the compact, providing for judicial +review; granting the commission certain emergency rulemaking authority under +certain conditions ARTICLE VII � OVERSIGHT, ENFORCEMENT AND DISPUTE RESOLUTION BY THE +INTERSTATE COMMISSION Specifying the oversight and monitoring responsibilities of the +commission; requiring courts and executive agencies in compacting states to +enforce the compact; providing for the resolution of compact disputes among the +states ARTICLE VIII � FINANCERequiring the interstate commission to provide for the payment of +reasonable expenses and to levy and collect annual assessments from compacting +states to cover the cost of internal operations and activities; specifying +certain funding restrictions and recordkeeping requirements ARTICLE IX � THE STATE COUNCILRequiring member states to create state councils for interstate +juvenile supervision, specifying certain membership requirements and powers ARTICLE X � COMPACTING STATES, EFFECTIVE DATE AND AMENDMENTSpecifying the eligibility of compacting states, including the U.S. territories; providing for the effective date of and amendments to +the compact ARTICLE XI � WITHDRAWAL, DEFAULT, TERMINATION AND JUDICIAL ENFORCEMENTProviding for withdrawal from the compact and for the imposition of +penalties for default, providing for suspension or termination of membership +under certain conditions; authorizing certain legal actions for compact +compliance enforcement purposes ARTICLE XII � SEVERABILITY AND CONSTRUCTIONProviding for severability of the compact and requiring liberal +construction ARTICLE XIII � BINDING EFFECT OF COMPACT AND OTHER LAWS Providing for the applicability of the compact and for compatibility +with laws of member states; compact to be binding on compacting states; +expanding certain juvenile provisions in the statutes to conform to the provisions of +the compact, prescribing the membership and duties of the advisory +council on interstate juvenile supervision and requiring the commissioner of +corrections to serve as the compact administrator, appropriating money to the +commissioner for obligations under the compact ARTICLE 2 � CONFORMING CHANGES Making conforming amendments to and repealing the existing interstate+ compact on juveniles except for certain provisions providing for counsel or +guardians ad litem and for enforcement (mk)
