E Relating to the environment; requiring the board of water and soil+ resources (BOWSR) by a certain date to implement a voluntary professional +wetland delineator certification program and by a certain later date to +report to the legislature on the implementation; requiring later development of implementation rules, requiring the rules to establish specific +standards for education, experience, testing, ethics and performance for persons +conducting regulatory delineations, requiring the board to charge a +certification fee for deposit in the special revenue fund to be used for the program; +expanding the responsibility of the pollution control agency to for provide section+ 401 certifications under the federal clean water act to all federal +permits or licenses requiring certification before issuance; requiring 401 +certification applications to undergo professional review, defining professional +review; restricting the authority of the PCA to waive 401 certifications; +imposing a time limit on PCA final determinations on certification +applications, requiring agency explanation for failure or refusal to make the +determinations; expanding the responsibility of the state under the state +environmental policy to coordinate state plans with local government plans; requiring the environmental quality board (EQB) to include by a certain date the consideration of relevant plans approved by local government units in environmental impact statement (EIS) rules and by the same date to +develop guidance for governmental units responsible for environmental review +of proposed actions, specifying certain guidance content requirements +and requiring an effectiveness report to the legislature by a certain +date (je, ja)
