1.1 A bill for an act 1.2 relating to government data practices; amending 1.3 assessor data; amending Minnesota Statutes 2002, 1.4 section 13.51, subdivision 2, by adding a subdivision. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2002, section 13.51, 1.7 subdivision 2, is amended to read: 1.8 Subd. 2. [INCOME PROPERTY ASSESSMENT DATA.] The following 1.9 data collected by political subdivisions from individuals or 1.10 business entities concerning income properties are classified as 1.11 private or nonpublic data pursuant to section 13.02, 1.12 subdivisions 9 and 12: 1.13 (a) detailed income and expense figuresfor the current1.14year plus the previous three years; 1.15 (b) average vacancy factorsfor the previous three years; 1.16 (c) verified net rentable areas or net usable areas, 1.17 whichever is appropriate; 1.18 (d) anticipated income and expensesfor the current year; 1.19 (e) projected vacancyfactor for the current1.20yearfactors;and1.21 (f) lease information; and 1.22 (g) any other data specifically requested by the assessor. 1.23 Sec. 2. Minnesota Statutes 2002, section 13.51, is amended 1.24 by adding a subdivision to read: 1.25 Subd. 4. [REQUEST FOR ACCESS TO OR DISCOVERABILITY OF 2.1 INCOME PROPERTY ASSESSMENT DATA.] Upon request to a responsible 2.2 authority or designee for access to or discoverability of income 2.3 property assessment data, as defined in subdivision 2, the 2.4 responsible authority or designee shall deny such request if the 2.5 responsible authority or designee determines that the person 2.6 requesting access or discovery did not supply the income 2.7 property assessment data to the assessor. The procedure for 2.8 judicial review of a denial of access shall be governed by 2.9 section 13.03, subdivision 8, and the procedure for judicial 2.10 review of a denial of discovery shall be governed by section 2.11 13.03, subdivision 6.
