Relating to the organization, operation and financing of state +government ARTICLE 1 � STATE GOVERNMENT FINANCEReducing appropriations to the legislative coordinating commission +(LCC) upon transfer of actuarial services duties from the legislative commission+ on pensions and retirement (LCPR) to the public pension funds, to the constitutional officers and to the commissioners of administration, +finance, employee relations (DOER), revenue and veterans affairs; providing a +general appropriation reduction to the commissioner of military affairs and appropriating money to the commissioner for the reenlistment bonus +and tuition and textbook reimbursement programs and for the national guard youth +camp; limiting per diem and housing allowances paid to legislators and +cancelling certain amounts of money to the general fund from amounts previously +carried forward in both the senate and the house; appropriating money to the commissioner of administration for state agency relocation costs; +providing for the nonapplication of lottery operating budget limits to new duties +relating to the lease of gaming machines; eliminating a certain standing +appropriation to the state elections campaign fund; classifying certain investment +data of the state board of investment; establishing the appropriation base for +statutory appropriations in detailed budget estimates not specifying a dollar +amount or for forecasted programs; requiring state revenue and expenditure +forecasts to include a separate discussion of the cost of applying inflation to expenditures; specifying certain procedures for commissioner of +finance consolidation and elimination of certain funds and accounts; creating+ the miscellaneous special revenue fund for deposit of revenues not placed+ in other funds; authorizing and providing for counties, cities or towns to opt+ out of state mandates, exceptions; establishing an at home infant child care+ program for state employees for the payment of subsidies in lieu of +assistance; requiring state employees using state vehicles for personal use to +reimburse employers at the standard mileage rate, amount to be deducted from +employee pay; increasing the limits under the tuition and textbook +reimbursement program for national guard members; modifying a certain eligibility +requirement for membership on joint armory boards, eliminating the requirement to be +a military officer; expanding the definition of corporation for corporate +political contributions regulation purposes; providing for sports themed +tipboard games for lawful gambling purposes; modifying certain first class city +teachers retirement fund association provisions; authorizing investment of +first class city TRA assets in the Minnesota supplemental investment fund; +requiring and providing for reimbursement of certain investment underperformance by+ the Minneapolis teachers retirement fund association through the +imposition of charges on benefit recipients; modifying certain direct state aid +payments to the first class city TRAs; reducing the dollar threshold basis for +potential surcharges for Minneapolis TRA supplemental administrative expenses, prescribing procedures for investment of state aid to the retirement +plan and modifying certain requirements for postretirement increases; +requiring the legislative auditor to conduct a review of the cost effectiveness of +the conservation improvement program, providing for funding; requiring +the director of the state lottery in consultation with the commissioner of finance+ to determine the amount of unclaimed lottery prize money and transfer +the money to the general fund; requiring and providing for the commissioner of administration to sell a certain additional amount of state land, to +lease a certain state owned building for use as a day care and after school +activity center and to repay the energy assessment account for certain +unauthorized expenditures, reductions in complement resulting from the repayment +to come from unclassified management positions; restricting the use of state +money to demolish the Ford building on University avenue in St. Paul, +requiring a commissioner of administration attempt to lease or transfer ownership+ of the building to a historic preservation entity at no cost to the state; +requiring the commissioner of finance to report to the legislature by a certain+ date on the different procedures for accounting for and appropriating +licensing fee revenue; appropriating money to the commissioner of administration +for a grant to assistive technology of Minnesota to administer a microloan +program to support the purchase of equipment and devices for people with +disabilities and to develop the access to telework program; requiring Mower county +reimbursement to the commissioner of finance for costs relating to the charges +brought against the American bankers insurance company under certain +conditions; repealing the expiration of a certain provision requiring the deposit+ of certain litigation or settlement proceeds in the general fund ARTICLE 2 � STATE BUDGET PROCESSMaking technical and clarifying changes in certain provisions +relating to the state budget process involving standing appropriations, the +distribution of fiscal notes, the transfer of control of state owned lands between +state departments and agencies, the disposal of old buildings, approval of +capital improvement plans, contracts and grants for natural resources +services, Minnesota zoo board professional services and purchase contracts, +county waste reduction and recycling funding, the rural rehabilitation revolving +account, Minnesota Technology, Inc., environment and natural resources trust +fund expenditures, hospital rate disclosure report filing fees, the +disposition of certain court awarded funds by the commissioner of human services, +the collection of delinquent state tax liabilities and the acquisition +and resale of property seized for unpaid taxes; eliminating the requirement for +the recommended revenue targets of the governor and legislature to +specify the mix and rates of income, sales and other state and local taxes and other +revenues; requiring the availability of certain updated information for +commissioner of finance reports on revenue relating to personal income; including +renewable energy programs for school children under the provision providing for+ natural resources services contracts and grants; authorizing school boards +to acquire, own, operate or sell energy from wind energy conversion systems ARTICLE 3 � FAIR CAMPAIGN REFORM ACT"Fair Campaign Reform Act"; transferring the primary responsibility +for the handling of complaints relating to fair campaign practices and +certain campaign finance reporting requirements from county attorneys to the campaign +finance and public disclosure board; increasing the membership of and +modifying certain provisions governing the board; providing compensation for board +members attending expedited hearings; prohibiting members or employees from +serving on committees supporting or opposing candidates or ballot questions and +from making or soliciting contributions; specifying certain notice +requirements of the board relating to delayed actions on complaints and delayed +advisory opinions issuance; expanding the advisory opinions issuance authority+ of the board to campaign finance reports and fair campaign practices issues; regulating board actions on complaints of unfair campaign practices, +providing for executive director review and expedited hearings; imposing fair +campaign filing fees on election candidates; transferring certain duties from +the secretary of state to the board; appropriating money to the board for complaints processing purposes; specifying certain renumbering +instructions to the revisor of statutes; eliminating certain duties of county +attorneys ARTICLE 4 � VOTING SYSTEM Appropriating funds remaining in the help America vote act account +after a certain date to the secretary of state for use in purchasing a +uniform statewide voting system; providing for secretary of state +solicitation and selection of voting systems complying with the requirements of the +help American vote act and for negotiation of master purchasing contracts ARTICLE 5 � HAVA CONFORMITYProviding for a single centralized interactive computerized statewide+ voter registration list to be administered and maintained at the state +level, specifying certain system requirements and certain requirements for +the acceptance of registrations and the entry of registration +information; restricting access to and use or sharing of social security numbers +maintained in the system; modifying certain absentee ballot procedures; +requiring secretary of state rules establishing vote counting standards; +providing for postelection review of a certain number of randomly selected +precincts; requiring voting systems accessible to disabled voters and +certification of equipment; providing for secretary of state approval in lieu of +licensing of electronic voting systems for experimental use; requiring secretary +of state agreements with the commissioners of health and public safety and the+ state court administrator for the electronic transfer of death, drivers +license and felony conviction records between agency systems ARTICLE 6 � ELECTIONS ADMINISTRATION TECHNICAL CHANGESEliminating postmasters from the list for inclusion by the secretary +of state in the legislative manual, reducing the number of copies to be +printed and distributed and the number to be made available to legislators and +adding county recorders and attorneys to the distribution list; requiring +certain multimember state agency data to be provided to the secretary of +state in electronic format and expanding the required data to electronic mail +addresses, requiring publication of the data including member vacancies on the +web site of the secretary of state in lieu of publication in the state register; +school district referendum notices not to be considered official ballots; +modifying certain requirements for deficient voter registrations and for +drivers license or identification card voter registration application procedures; +requiring school districts to biannually distribute voter registration forms to+ students eligible to vote at the next election; requiring registration of +inactive registrants; increasing the county auditor retention period for +prescribed polling place rosters; expanding county or legislative district +precinct caucus notice requirements to municipal clerks and extending the information availability requirement; modifying the requirement for county +auditor offices to remain open before elections to accept absentee ballot +applications and imposing the requirements on the offices of city or town clerks; +granting the secretary of state the authority to designate alternative methods for+ handling absentee ballots during declared national or state emergencies; +clarifying certain nominating petition requirements; clarifying the inclusion of+ school district elections and referenda under the time limit for designation+ of new polling places; modifying certain election judge qualification +requirements; qualifying home schooled students for service as trainee election +judges and eliminating the requirement for high school students completion of or enrollment in a government course; prohibiting the counting of +trainee election judges toward the minimum required number of election judges; +modifying certain judicial election notice and ballot form requirements; modifying the +procedure for the provision of official supplemental ballots to absentee or +requesting voters; authorizing county auditors or municipal clerks by written authorization to permit news media representatives to enter polling +places for a limited period of time to observe the voting process, restrictions; prohibiting use of the absence of election judge initials on ballots +to disqualify the ballots under certain conditions; requiring county +canvassing board reporting of write in candidates to the county auditor; +limiting the scope of and modifying the procedure for automatic recounts, +requiring payment for ballot question recount expenses by the local government unit +placing the question on the ballot and clarifying the procedure for recounting by+ precinct; providing for the placement of uncontested judicial offices on the +ballot; requiring the secretary of state to supply county auditors with +copies of example supplemental ballots and county auditors to distribute copies+ to municipal and school district clerks before the election; eliminating+ the authority of county auditors to issue certificates of legislative +special elections; requiring candidates for town supervisor to designate the +specific seat sought in multiple seat elections; extending the time limit for +municipal or school or hospital district clerk election notices to county +auditors and requiring county auditor notice to the secretary of state; clarifying+ certain canvassing requirements and transferring certain governing body or +municipal clerk canvassing duties to canvassing boards; requiring the printing+ of the words official ballot on the front of the ballot; permitting +electronic filing of campaign finance reports; clarifying the procedure for withdrawal +or resignation from office; authorizing the consideration of ballot +questions at annual town meetings; requiring town treasurers to perform certain +election duties of town clerks under certain conditions; clarifying certain +petition signature requirements to initiate proceedings for the consolidation +of municipalities; modifying the filing period for affidavits of +candidacy for hospital district elections ARTICLE 7 � UNIFORM STATE AND LOCAL ELECTION DATES"Periodic Uniform Election Day Act of 2004", providing for periodic +uniform election days for state and local elections and ballot questions, +excepting special elections to fill vacancies, designating the days for the +elections, providing for primary elections, requiring elections to be held at +the same polling places and during the same hours as the state general +election, providing for the applicability of Minnesota election law; +authorizing cities, towns or school districts to designate by resolution the time for +polling places to remain open for elections not held at the same time as the +state primary or state general election, specifying minimum polling hours +and providing for petitions requesting longer voting hours ARTICLE 8 � ELECTION ADMINISTRATIONModifying certain elections provisions; providing for compliance of +certain provisions with the federal help America vote act (HAVA); imposing a +state and local government unit maintenance of effort requirement relating to +election activity and voting equipment expenditures; imposing or modifying +certain voter registration application and notice requirements; modifying certain +public information list availability requirements; imposing certain +additional duties on the secretary of state; authorizing certain reports by electronic +means; providing for verification of new voter registrations; modifying +certain polling place roster and absentee ballot application procedures, +requiring certain instructions to and statements by absentee voters and +regulating the mailing of ballots and the use of ballot envelopes; modifying certain+ election judge duties and polling place requirements; regulating mail +balloting; modifying the consequences for refusal to answer questions or sign +polling place rosters; modifying certain precinct summary statement +requirements; specifying certain requirements for certificates of election judges +and for county auditor records of delivered election materials; providing for+ an election results reporting system for local and school district +elections; modifying the definition of counting center for election law +application purposes; imposing a minimum time limit for electronic system voting;+ providing for appointments to fill vacancies in the office of county +commissioner resulting from death; repealing certain rules regulating voter +registration and absentee ballots ARTICLE 9 � ELECTRONIC REAL ESTATE RECORDING TASK FORCEModifying the membership of the electronic real estate documents +filing and recording task force and specifying the term; designating the +secretary of state as the chair of the task force; authorizing subcommittees; +requiring the task force to provide an updated report to the legislature by a +certain date containing a revised work plan and budget;
