Authorizing and providing for cities and towns to require the +dedication of land for public purposes for planning and zoning purposes and +modifying certain fee imposition authority, regulating fee ordinances and ordinance +amendments and appeals and prohibiting the conditioning of approval of proposed subdivisions or developments on an agreement to waive the right to +challenge the validity of a fee in lieu of dedication; prohibiting the use of +cash payments received for ongoing operation or maintenance; requiring +establishment of the basis for calculating the amount to be dedicated or preserved +by ordinance or by fee schedule; requiring an essential nexus between +the fees or dedication and the purpose sought to be achieved by the fee or +dedication, proportionality requirement; specifying certain conditions for +applications to proceed before payment of the fee pending appeal (Ch. 178, 2004)
