HF 2095 Senate Long Description

Regulating mortgage foreclosure consultant contracts and +reconveyances, defining foreclosure consultant, reconveyance and residence in +foreclosure and purchaser; providing for the right of property owners to cancel +foreclosure consultant contracts; specifying certain contract form and content requirements; enumerating certain consultant violations; prohibiting +waivers; prescribing remedies and penalties; severability clause; voiding +contract provisions requiring arbitration of disputes at the option of the +owner; specifying certain foreclosure purchaser contract requirements, +prescribing the form, content and the terms; providing for the right of homeowners to+ cancel the contracts, notice requirements; prohibiting waiver of contract requirements, exception; voiding contract provisions requiring +arbitration of disputes at the option of the owner; specifying certain prohibited +practices of foreclosure purchasers; providing for enforcement through actions +brought by foreclosed homeowners; modifying the definition of eligible mortgagor+ for housing finance agency purposes relating to the percentage return to +limited dividend entities, increasing the allowable return and authorizing +the HFA to refinance long term mortgages; prohibiting common interest +communities (CICs) from prohibiting or limiting housing and redevelopment authorities +(HRA) from leasing owned residential units to eligible persons of low or +moderate income, authorizing regulation of the use of the unit or enforcement of +prohibitions against leasing residential units in effect before authority +ownership, providing for applicability; specifying certain mortgage foreclosure +advice notice requirements; expanding the authorized use of a certain prior appropriation to the HFA to the acquisition, rehabilitation and debt restructuring of existing supportive housing; severability clause (Ch. 263, 2004)
