SF 37 Senate Long Description

Relating to energy; excluding independent spent fuel storage +installations located on nuclear generation facility sites for dry cask storage of +spent nuclear fuel generated by the facilities from the definition of +radioactive waste management facility; increasing the amount of money required to+ be transferred annually by the public utility owning the Prairie Island +nuclear generating plant to a renewable development account under certain +contracted biomass project termination conditions; requiring annual allocation +of a certain amount of money from the renewable development account to +support basic and applied research at the university of Minnesota hydrogen and renewables research center, specifying certain research +focus requirements; temporarily requiring annual allocation of a certain +amount of money in the account to fund the renewable energy production +incentives for electricity generated by certain larger wind energy conversion +systems, requiring the department of commerce to determine project eligibility+ and providing for payments; authorizing additional dry cask storage at +the Prairie Island nuclear power generating plant subject to certain federal +license limits, requiring a certain settlement agreement between the +Mdewakanton Dakota tribal council at Prairie Island and the public utility to provide +for payments to acquire land for placement in trust for housing and other +residential purposes; subjecting future authorization of additional dry cask +storage or expansion or establishment of an independent spent fuel storage +facility to certificate of need approval by the public utilities commission and +legislative ratification, specifying certain spent nuclear fuel storage +management requirements relating to facilitating shipment of the waste out of +state, imposing certain water standards on independent spent fuel +installations and subjecting storage installations to certain environmental review and +protection requirements; providing a hydrogen energy economy goal; prohibiting +the use of service or load limiters or interrupters under the cold weather rule;+ requiring the PUC to approve a rate schedule providing for automatic adjustment+ of charges to recover the costs or expenses of a settlement between the +public utility owning the Prairie Island nuclear generation facility and the Mdewakanton Dakota tribal council to resolve certain outstanding +disputes, specifying certain settlement requirements; expanding the definition of eligible energy technology for renewable energy +objectives purposes to energy recovery facilities used to capture the heat value+ of mixed municipal solid waste or refuse derived fuel (RDF) as a primary fuel +and providing a good faith objective, requiring public electric utilities+ to determine necessary transmission upgrades to support development of +renewable energy resources required to meet the renewable energy objective, +transmission capacity upgrades to qualify for rate treatment under power purchase +contracts under certain conditions; providing an alternative for the biannual +filing of conservation improvement plan overviews by certain smaller municipal +utilities under certain conditions and authorizing spending of a certain +percentage of required conservation improvement investments to refurbish existing +district heating or cooling systems; increasing the maximum number of +megawatts of biomass electricity installed capacity for facilities using poultry +litter as a primary fuel source and for the St. Paul district heating and cooling+ system cogeneration facility using waste wood as a primary source; requiring certificates of need for additional storage of spent nuclear fuel for facilities seeking a license extension to address the impacts of +continued operations; authorizing townships to enter into agreements with +public utilities providing natural gas services to provide services within +the township after annexation; modifying the membership and certain responsibilities and extending the expiration date of the legislative+ electric energy task force, requiring the task force to study and make +recommendations to the legislature on issues relating to potential electric energy +resources and to the transportation of spent nuclear fuel to repositories +outside the state and increasing the maximum public utilities assessment amount +allowed for operation of the task force; modifying certain utility assessment +requirements for certain expenses of the reliability administrator in the +department of commerce; modifying the definition of qualified wind energy +conversion facility for renewable energy production incentive eligibility purposes, +modifying the eligibility window and payment period and the payment amount limit +for certain wind energy facilities, specifying certain requirements for wind +energy systems incentive eligibility and certain time limits for commissioner of +commerce approval or denial of applications and for operation of approved +facilities; requiring and providing for commissioner additional incentive +payments to certain wind energy facilities; reducing the biomass mandate and +prohibiting PUC approval of requests for deadline extension to obtain financing +after a certain date; providing for the refurbishment of electric generation +facilities in the metropolitan area described in the emission reduction plan +filed with the PUC; authorizing providing for the creation of energy enterprise +zones, specifying certain energy project eligibility requirements for +designation by the commissioner of the iron range resources and rehabilitation board+ (IRRRB) and certain regulatory incentives for designated projects; +authorizing the PUC to review the appropriateness of the transfer of the administration +of the renewable development account by an organization; requiring the +department of trade and economic development to develop a targeted program to +promote and encourage the development and attraction of businesses engaged in the biocatalysis of agricultural and forestry plant products for the +production of hydrogen and report to the legislature by a certain date on +legislative changes or additional funding needed for the program; requiring the +commissioner in consultation with the commissioners of commerce and revenue to +develop a plan to designate a certain number of energy innovation zones to spur the development of energy efficiency and renewable energy technologies, +specifying certain factors for consideration in developing criteria and +requiring a report to the legislature by a certain date; requiring the department of +commerce in cooperation with DTED to develop a request for proposals for the +construction of a hydrogen to electricity demonstration project with certain +specified components; sunsetting the funding for hydrogen economy research and +for municipal utility refurbishment of existing district heating or +cooling systems; repealing certain responsibilities of the legislative +electric energy task force(mk)
