Relating to gambling and the state lottery, providing for gaming +machines at the racetrack (racino); defining or redefining certain terms under +the state lottery relating to gaming machines; authorizing and providing for +the director of the state lottery to enter into a gaming machine location contract+ with a holder of a class A racetrack license for placement at an existing +racetrack, specifying certain contract requirements relating to racetrack, city +and county compensation; requiring and providing for operation and control of +the machines by the director; specifying certain requirements for gaming machines +and requiring the director to specify the games allowed to be placed on +the machines and to examine or contract for the examination of machine +prototypes; providing for the testing of machines; specifying certain +requirements of persons claiming prizes; prohibiting play by minors and lottery +employees and families; specifying certain compulsive gambling notice posting +requirements of the director, requiring the director and the location provider to +establish a proactive plan to identify problem gamblers and take appropriate +action, requiring annual director reports to the legislature on plan +performance objectives and progress toward the objectives; prohibiting local +license requirements and restrictions; requiring the racing commission to +require licensees to reimburse the commission for personnel and regulation +costs, requiring crediting to the reimbursement account; requiring a certain percentage of adjusted gross gaming machine revenues to be set aside +by the licensee for purses for live horse races, requiring transfer of a +certain portion to the commission for races for Minnesota thoroughbred, +quarterhorse and standardbred categories, authorizing the licensee and the +horsepersons organization to negotiate different percentages upon filing of an +agreement with the commission; imposing an in lieu sales tax on adjusted gross +revenue from the machines and providing for use; exempting the machines from +gambling device license requirements and authorizing sale of the devices to +the state lottery; excluding the purchase of gaming machine plays from the +provision allowing recovery through civil action of money lost to gambling +debts and from the definition of bets for gambling crimes purposes; prohibiting +racino contracts by the director upon tribal legally binding agreements +submitted to the governor relating to certain contributions to the state and not +increasing the number of video games of chance operated by the tribes, +moratorium to cease upon breach of the agreements; severability, savings clause (mk)
