Relating to the organization, operation and financing of state +government; appropriating money for transportation, public safety and certain +other purposes ARTICLE 1 � TRANSPORTATION AND OTHER AGENCIES APPROPRIATIONS Appropriating money to the commissioner of transportation (DOT) for +multimodal systems including aeronautics, transit, freight and commercial +vehicles, for state and local roads and for general support and services, to the +metropolitan council for bus transit and rail operations including the Hiawatha +light rail transit line, to the commissioner of public safety for administration+ and related services including public safety officer survivor benefits +and soft body armor (bullet proof vests) reimbursements, for the state patrol +including capitol security, for driver and vehicle services, for traffic and +pipeline safety and for alcohol and gambling enforcement and to the +commissioner of commerce for the weights and measures division to inspect and test +petroleum measuring equipment, providing for temporary inspections cost +recovery; requiring the commissioner of transportation to provide funding for +operation of the Northstar commuter coach between certain dates under certain +operation and local match conditions; providing grants for metropolitan +planning and transportation studies outside the metropolitan area; requiring the metropolitan council to submit to the Hennepin county regional rail +authority by a certain date a proposed operations management plan for the +Hiawatha LRT; requiring the commissioners of public safety and transportation to +jointly annually report to the legislature on the expenditure of federal +funds available under the repeat offender transfer program, requiring use +of a certain percentage for certain hazard elimination activities; +requiring budget base reduction reports to the legislature by the commissioners of transportation and public safety and the metropolitan council; +providing for certain fund transfers, for extended availability of certain +appropriations, for general contingent accounts and for the payment of tort claims ARTICLE 2 � OTHER CHANGES RELATED TO TRANSPORTATION AND PUBLIC SAFETYRequiring the commissioner of transportation (DOT) to use the greater+ Minnesota transit fund for transit operations and related administration under +the public transit subsidy program; specifying certain appraisal and negotiation requirements for the acquisition of property for highway or +transportation facilities or purposes under eminent domain, classifying the data +provided to the property owner as public; increasing the limit on reimbursement +to private property owners for appraisal fees relating to direct purchase under +eminent domain; restricting the involvement of the state archaeologist with archaeological or historic sites to existing sites; authorizing the commissioner of transportation to charge user fees to single occupant+ vehicle owners or operators using designated high occupancy vehicle (HOV) +lanes on trunk highways, penalty provision, requiring use of certain fee +proceeds for transportation capital improvements and for the metropolitan council +for expansion and improvement of bus transit services within the +corridor; requiring commissioner biennial reports to the legislature on total expenditures from the trunk highway fund in certain categories; +eliminating the prohibition on payment of sales tax expenses from the trunk highway +fund; authorizing the commissioner to enter into agreements with Indian +tribal authorities to provide maintenance, design and construction to +highways on tribal lands; eliminating certain obsolete provisions relating to +joint county state aid highway and municipal state aid street status and certain requirements for the department of transportation to forward copies +of certain rules or orders to county auditors and to maintain a list of eligible+ county highway engineers; authorizing and providing for county board +designation of vacated county highways as county cartways, restricting expenditures +on the cartways from road and bridge funds, prohibiting the reversion to +towns of county highway rights-of-way removed from the county highway system +without a hearing, authorizing transfer of jurisdiction over county highways +upon agreement between the county and the authority, agency or tribe of +transfer; providing for mediation or arbitration in the settlement of disputes +between adjoining towns over the division of responsibilities for +establishing, altering, vacating or maintaining town line roads; expanding the +definition of special mobile equipment for motor vehicle registration purposes to +truck mounted log loaders; modifying certain seasonal highway weight +limits; authorizing the issuance of more than one set of special license +plates to volunteer ambulance attendants, requiring return of the plates upon +termination of status; imposing certain license plate and sticker issuance fees; establishing procedures for authorization and issuance of new special+ motor vehicle license plates to certain requesting entities; providing for +the issuance of special Rotary member license plates to members of Rotary international; increasing the motor vehicle transfer and certificate +of title issuance fees; modifying the maximum speed limit in school zones; +placing certain additional conditions on the operation of certain school +buses by licensed child care providers without an endorsement; requiring and +providing for the commissioner of public safety to implement a monthly sampling+ program to verify automobile insurance coverage; requiring commissioner +suspension of drivers licenses for failure to provide vehicle insurance, imposing a reinstatement fee and requiring attestation of insurance; modifying +certain highway weight limit increases and increasing the weight limit for +vehicles and vehicle combinations on nine ton county roads during the winter +season; increasing surcharge for reinstatement of drivers licenses after +revocation for driving while impaired (DWI) offenses and requiring a certain +percentage of the surcharge to be used for vehicle forfeiture costs and modifying +certain other allocation requirements; requiring and providing for the +commissioner of transportation to biannually prepare highway user tax distribution +and trunk highway fund revenues and expenditures forecasts; reducing the +operating assistance percentages under the public transit subsidy program, +authorizing certain payment adjustments to certain recipients and providing for +payments from the greater Minnesota transit fund; sunsetting the major +transportation projects commission; modifying the allocation of revenue from the +sales tax on motor vehicles; modifying certain conditions for reimbursement to +public employers for the costs of complying with certain health insurance +continuation coverage requirements for certain retired or separated peace officers+ and firefighters suffering disabling injuries in the line of duty; +creating an alcohol enforcement account to be used for certain department of +public safety alcohol and gambling division enforcement and administration costs +and for costs of the state patrol; granting the commissioner of public safety+ certain administrative and enforcement powers relating to motor vehicle +registration and drivers license issuance, creating an education and compliance +account for the deposit of administrative penalty order receipts; requiring +towing policy and practice for vehicles in capitol complex public parking spaces to+ conform to certain towing regulation provisions; sunsetting the capitol +complex security oversight committee; providing for web site publication of +local transportation project requests for proposals; requiring +municipalities issuing .2 malt liquor (beer) licenses to provide certain information to the commissioner; requiring alcoholic beverage consumption and display +permits (bottle clubs and set-ups) to obtain authorization from the +commissioner for extended hours of operation, imposing an annual authorization fee; +requiring on-sale alcoholic beverage retailers to obtain a permit from the +commissioner to sell liquor during extended hours, imposing certain fees; +providing for the effect of annexation on township roads and easements; extending the availability of certain prior appropriations to the commissioner of transportation for airport development and assistance; eliminating +the expiration date for a certain provision exempting certain utility and+ recycling vehicles from certain highway weight restrictions and for certain +modifications to the definition of commercial motor vehicle for drivers license +endorsement purposes; requiring the commissioner of finance to transfer certain +funds from the transportation revolving loan fund and the remaining balance in +the alcohol impaired driver education account in the special revenue fund to the +general fund; requiring the commissioner of transportation to study the +status of the highway rest area program and the feasibility of using centerline +rumble strips during highway construction and of implementing a bus rapid transit +(BRT) system in the I-35W corridor between downtown Minneapolis and the +cities of Richfield, Bloomington, Burnsville and Lakeville, requiring reports +to the legislature by certain dates; prohibiting the metropolitan council +from reducing public access to services and facilities at the Hubbard +marketplace transit station; requiring the metropolitan council to prepare a +request for proposals to operate the Hiawatha light rail transit line (LRT); +authorizing Itasca county to exchange certain land to acquire real property for +county highway maintenance facilities; prohibiting the commissioner, the +metropolitan council or the Hennepin county regional rail authority from taking +action or spending money for preliminary engineering, final design or +construction of light or commuter rail transit in the southwest transit corridor +between the cities of Minneapolis and Eden Prairie; authorizing the commissioner +in conjunction with the Northstar corridor development authority to +convene a work group to further study the feasibility of constructing the Northstar +commuter rail, requiring a report to the legislature by a certain date; +requiring the commissioner of revenue in consultation with the hospitality industry+ to conduct a study to determine the amount of annual increase in state +tax revenue attributable to changes in the hours of permissible sale of alcoholic+ beverages and report to the governor and the legislature by a certain date; +requiring the metropolitan airports commission (MAC) to allow public participation+ in the taxicab advisory committee; accelerating the effective date for +certain provisions extending the hours for on-sales of alcoholic beverages; +repealing a certain provision exempting drivers license revocation for failure to+ provide automobile insurance from certain department of commerce +investigation procedures, the requirement for insurer notice to the commissioner of+ public safety of lapse in insurance coverage, a certain prohibition on DOT commissioner establishment of new divisions within the department, a +certain requirement for the commissioner to establish a series of highway +jurisdiction studies and a collective ratemaking procedure for shippers and +receivers, property tax replacement aid, and certain provisions requiring a +certificate of public convenience and necessity from the commissioner to transport +certain commodities by pipeline and certain rules setting license plate and +validation sticker fees, requiring the provision of certain insurance +information upon vehicle transfer, governing design standards for driveways near trunk+ highways, municipal airports, common carriers, interstate highways and +collective ratemaking; sunsetting the alcoholic beverage sales notice and permit requirements under certain commissioner of revenue reporting +conditions ARTICLE 3 � TRUNK HIGHWAY BONDINGAppropriating money to the commissioner of transportation (DOT) and +authorizing the issuance for state bonds for certain trunk highway improvements, +requiring equal allocation between the department metropolitan district and the+ remainder of the state and commissioner annual reports to the legislature on +selected projects; requiring cancellation of unencumbered appropriations to +the trunk highway bond account in the state bond fund; authorizing the +commissioner to spend a certain amount of certain federal funds for advance +construction on trunk highway improvements and requiring annual advance construction +reports by the commissioner to the legislature; authorizing the commissioner to +spend a certain amount of federal transit funds for capital assistance to +public transit systems under the public transit subsidy program; requiring commissioner annual reports to the legislature on trunk highway +improvement expenditures ARTICLE 4 � FISCAL YEAR 2003 APPROPRIATIONS AND TRANSFERSTransferring and cancelling certain prior appropriations to the +commissioner of transportation (DOT) for bonding projects, authorizing the issuance +of bonds for the projects and appropriating money to the commissioner of +finance for bond sale expenses (Ch. 19, Special Session 2003)
