Requiring and providing for the director of the state lottery to +establish a state run gaming facility in the metropolitan area, authorizing +solicitation of bids from interested cities and a city opt out; requiring a contract +to divide the proceeds with tribal governments choosing to be a party to the +contract, requiring a tribal council resolution by a certain date, agreement +not to affect existing tribal state compact, specifying certain minimum +agreement content requirements and duration, requiring periodic negotiation and+ renewal; requiring the director to construct, purchase or lease equipment and +facilities for operation of the facility and authorizing contracts with private +vendors for goods and services, requiring efforts to contract with minority +owned and American Indian businesses and vendors and the establishment of +standards for the contracts; authorizing a contract with a facilities manager, +director to maintain control of facility operations; providing for the +appointment of employees; restricting the types of games at the facility, requiring +the director to determine procedures for the games and specifying a +minimum number of gaming machines requirement; regulating the awarding of prizes; +prohibiting play by minors; authorizing and providing for the detention of +suspected violators and for the issuance of revenue bonds to finance the +facility; requiring the commissioner of public safety to issue an on-sale +intoxicating liquor license for the facility; authorizing the director to charge +user fees; prohibiting local licensing, restrictions or regulation; granting +immunity from civil liability to state and tribal governments resulting from +activities, exceptions; exempting the facility from the smoking ban in state +buildings; imposing a sales tax on adjusted gross revenue from the facility, +defining adjusted gross revenue and requiring deposit of the taxes received by+ the commissioner of revenue in a gaming facility proceeds fund for +transfer to tribal governments, for appropriation to the department of children, +families and learning (CFL) for the Indian education program, to the +department of human services for programs and services for American Indians living in +urban areas and for the compulsive gambling treatment program, to the department +of trade and economic development (DTED) for a grant to a nonprofit +corporation to provide loans and business education to Indians living in urban areas+ and to the commissioner of economic security for grants to nonprofit +entities providing for promotion and development of minority and Indian +business opportunities in urban areas and for transfer to the city of facility+ location, remainder to be deposited in the general fund; excluding the machines+ from the definition of gambling device and activities from the definition of +gambling debts for money recovery purposes and from the definition of bets for+ gambling crimes purposes; authorizing director rules; establishing a temporary+ urban entertainment and gaming advisory council, specifying membership +requirements and duties; appropriating money to the director for certain facility +costs, repayment requirement (ra)
