prohibiting a further rebasing of rates +under the general assistance medical care, medical assistance (MA) and +MinnesotaCare programs for inpatient hospital operating payment rates determination+ purposes and providing additional reductions in the total payments for fee +for service inpatient admissions and outpatient hospital facility services +occurring after a certain date before third party liability and spenddown; providing + medical assistance eligibility for persons residing in institutions for +mental diseases and modifying certain eligibility requirements relating to earned +income disregards; qualifying eligibility for pregnant women and requiring +the deduction of dependent care and child support paid under court order +from countable income; expanding eligibility for children and modifying +eligibility for employed persons with disabilities; clarifying the application of+ and extending the period for certain prohibited transfers and modifying +the period of ineligibility for uncompensated transfers, specifying certain +federal approval requirements; eliminating the eligibility of certain +pregnant noncitizens and providing eligibility for certain victims of torture; eliminating certain retroactive eligibility provisions; providing +medical assistance coverage for certain anorectics or drugs used for weight +loss; eliminating the honorarium for members of the drug formulary +committee; limiting the monthly supply of drugs for coverage purposes; +eliminating coverage for multisource drugs and modifying the conditions for +coverage of brand name drugs; requiring and providing for copayments for receipt +of medical assistance; requiring federal funding for continued medical +assistance payments to certain employed persons or persons receiving increased child or +spousal support payments; establishing and providing for the applicability of+ a policy requiring the use of personal assets to pay for the cost of care +during or after enrollment in the medical assistance program; providing for the+ filing of claims or potential claims against estates by state agencies, notice +to constitute a lien against certain estate property, providing for +claims against estates of specific persons receiving medical assistance and of +persons or decedents receiving medical assistance and survived by others and +modifying certain other claims provisions relating to survivors; requiring the +increase in intergovernmental transfers due to the reduction in fee for +service rates paid to inpatient hospitals to be paid to the general fund; expanding+ the exemptions from participation in the medical assistance prepayment demonstration project to persons with access to cost effective +employer sponsored private health insurance or to cost effective individual +health plans and reducing the total payment to managed care plans under the +program, exceptions; requiring payments for physician and professional +services to be based on medicare relative value units (RVUs); modifying certain +eligibility requirements under GAMC and sunsetting the program after a certain +date, persons enrolled in the program to be converted to MinnesotaCare +based on eligibility; specifying certain GAMC copayment and coinsurance +requirements; transferring funding for the MinnesotaCare program to the general +fund after a certain date, modifying certain copayment and coinsurance +requirements and eliminating family coverage for dependent siblings, requiring +application as a separate household; replacing the community services +development grant program with the consolidated ElderCare development grant fund +to rebalance the long term care system and increase home and community +based care alternatives, specifying the services eligible for funding, modifying+ the match requirement and eliminating the grant limit; modifying certain +eligibility and cash payment requirements and services covered under the medical +assistance (MA) alternative care program and providing for the administration of+ pilot projects; modifying certain case management requirements; providing +for the reallocation of alternative care base allocations to lead agencies on+ agreement between the commissioner of human services and the lead agency; +modifying a certain provision providing for the payment of client premiums; +eliminating the exclusion of alternative care for nonmedical assistance recipients +from the definition of medical assistance for claims against estates purposes +and entitling counties to a certain percentage of collections; requiring +additional transfers by certain counties for the nonfederal share of medical +assistance nursing home costs; further restricting certain payments to nursing facilities, providing an additional adjustment and providing a new +formula for determination of payments during the first 90 days after admission; increasing the county share of +the costs for care provided in regional treatment centers (RTC) or nursing +facilities except the Minnesota security hospital, the Minnesota sex offender +program or the Minnesota extended treatment options program; eliminating the +hourly job coach follow along rate for services provided to persons with mental retardation, authorizing the commissioner of human services to +authorize county participation in voluntary individualized payment rate structures for+ day training and habilitation services to change from a site based to an +individual rate structure; modifying the consumer support grant program for +individuals with functional limitations, excluding individuals receiving home and+ community based waivers from program eligibility; providing medical assistance +(MA) coverage for certain medically necessary intensive rehabilitative +mental health services subject to federal approval, specifying certain eligibility requirements and certain standards for residential and nonresidential+ services; sunsetting medical assistance coverage for day treatment for adults; +modifying state and county division of cost requirements for certain +intermediate care or nursing facility placements; providing medical assistance coverage +for certain day services for persons residing in ICF/MR, requiring a certain +payment rate reduction and eliminating the requirement for counties to provide for+ day training and habilitation services in county social services plans; requiring and providing for county +boards to provide for mental health screening of certain children receiving +certain protective services or under court jurisdiction, authorizing court consideration of screening results in certain placement +determinations; eliminating a certain requirement for counties to provide expanded +mental health services to adults and children; providing medical assistance +(MA) coverage for certain mental health, psychiatric and therapeutic +services and supports; eliminating medical assistance coverage for services for +children with severe emotional disturbance provided by institutions for mental+ disease (IMD); eliminating the requirement for providers to use certain +federal funds to expand preventive child welfare services under the Minnesota +family preservation act; providing adoption assistance eligibility for +certain Indian children; specifying certain cross reference deletion instructions to+ the revisor of statutes; repealing medical assistance coverage for +certain existing community and therapeutic support services and certain related rules ARTICLE 6 � COMMUNITY SERVICES ACT"Children and Community Services Act"; requiring notice to recipients +receiving IV-D child support services no longer receiving certain other assistance +of the continuation of IV-D services including the implications of +continuing and the fees involved, providing for collection of a cost recovery fee from +certain obligees; changing the requirement for testing of infants for inborn metabolic +errors to testing for heritable and congenital disorders, requiring +commissioner appointment of an advisory committee; eliminating rural hospital +grants; modifying the penalties for breach of contract under the national +health services corps state loan repayment program; establishing a health +professional education loan forgiveness program for medical practitioners agreeing+ to practice in underserved urban communities; specifying certain reference and cross reference deletion +instructions to the revisor of statutes; repealing the medical education and tobacco use +prevention endowment funds, certain medical practitioners loan forgiveness +programs and related rules, nursing home transition planning and long term care +quality innovations demonstration grants and certain fee surcharges ARTICLE 9 � LOCAL PUBLIC HEALTH GRANTSRequiring the emergency medical services (EMS) regulatory board and administrative law judge to consider recommendations of community +health boards in reviewing applications for licensure; modifying certain provisions+ providing for maternal and child health block grants, providing for +accountability; modifying certain community health board and services provisions, +changing community health subsidies to local public health grants and +providing for the grants, imposing certain additional duties on the boards, modifying +certain duties of state and local advisory committees, requiring the +commissioner of health to establish statewide outcomes for grant funds between +certain dates and sunsetting the grants;
