  1.1                          A bill for an act 
  1.2             relating to state government; requiring the board of 
  1.3             water and soil resources to repeal an unauthorized 
  1.4             wetland replacement rule; requiring a rule amendment. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [RULE REPEAL; WETLAND DRAINAGE.] 
  1.7      (a) The board of water and soil resources shall not enforce 
  1.8   the provision in Minnesota Rules, part 8420.0122, subpart 3, 
  1.9   item A, that provides that "This exemption does not apply to a 
  1.10  project with the purpose of converting a wetland to a 
  1.11  nonwetland, either immediately or gradually, or converting the 
  1.12  wetland to another use, or when the fill will result in 
  1.13  significant discernible change to the flow or circulation of 
  1.14  water in the wetland, or partly draining it, or reducing the 
  1.15  wetland area." 
  1.16     (b) The board must amend Minnesota Rules, part 8420.0122, 
  1.17  subpart 3, item A, to delete the provision described in 
  1.18  paragraph (a).  The board must comply with Minnesota Statutes, 
  1.19  section 14.388, clause (3), in adopting the amendment. 
  1.20     Sec. 2.  [EFFECTIVE DATE.] 
  1.21     Section 1 is effective the day following final enactment.
