1.1 A bill for an act 1.2 relating to unemployment insurance; modifying 1.3 eligibility provisions relating to social security 1.4 benefits; amending Minnesota Statutes 2002, section 1.5 268.085, subdivision 4. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 268.085, 1.8 subdivision 4, is amended to read: 1.9 Subd. 4. [SOCIAL SECURITY BENEFITS.] (a) Any applicant 1.10 aged 62 or over shall be required to state when filing an 1.11 application for unemployment benefits and when filing continued 1.12 requests for unemployment benefits whether the applicant is 1.13 receiving, has filed for, or intends to file for, primary social 1.14 security old age or disability benefits for any week during the 1.15 benefit year. 1.16 (b) There shall be deducted from an applicant's weekly 1.17 unemployment benefit amount 50 percent of the weekly equivalent 1.18 of the primary social security old age or disability benefit the 1.19 applicant has received, has filed for, or intends to file for, 1.20 with respect to that week. 1.21 (c) Regardless of paragraph (b), an applicant shall be 1.22 ineligible for unemployment benefits for any week with respect 1.23 to which the applicant is receiving, or has received,or has1.24filed forprimary social security disability benefits. Any 1.25 retroactive lump sum social security disability payments made to 2.1 the applicant for the period the applicant received unemployment 2.2 benefits shall be used to repay the fund for the unemployment 2.3 benefits paid to the applicant for that period. 2.4 This paragraph shall not apply if the Social Security 2.5 Administration approved the collecting of primary social 2.6 security disability benefits each month the applicant was 2.7 employed during the base period. 2.8 (d) Information from the Social Security Administration 2.9 shall be considered conclusive, absent specific evidence showing 2.10 that the information was erroneous. 2.11 (e) Any applicant who receives primary social security old 2.12 age or disability benefits for periods that the applicant has 2.13 been paid unemployment benefits shall be considered overpaid 2.14 those unemployment benefits under section 268.18, subdivision 1.
