  1.1                          A bill for an act 
  1.2             relating to professions; modifying restrictions on 
  1.3             electrical apparatus work; amending Minnesota Statutes 
  1.4             2002, sections 326.01, subdivision 6l, by adding a 
  1.5             subdivision; 326.245, subdivisions 2, 3, 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 326.01, 
  1.8   subdivision 6l, is amended to read: 
  1.9      Subd. 6l.  [TECHNOLOGY CIRCUITS OR SYSTEMS.] "Technology 
  1.10  circuits or systems" means class 2 or class 3 circuits or 
  1.11  systems for, but not limited to, remote control, signaling, 
  1.12  control, alarm, and audio signal, including associated 
  1.13  components as covered by the National Electrical Code, articles 
  1.14  640, 645, 725, 760, 770, and 780, and which are isolated from 
  1.15  circuits or systems other than class 2 or class 3 by a 
  1.16  demarcation and are not energy management circuits or systems or 
  1.17  process control circuits or systems; antenna and communication 
  1.18  circuits or systems as covered by chapter 8 of the National 
  1.19  Electrical Code; and circuitry and equipment for indoor lighting 
  1.20  and outdoor landscape lighting systems that are supplied by the 
  1.21  secondary circuit of an isolating power supply operating at 30 
  1.22  volts or less as covered by the National Electrical Code, 
  1.23  article 411.  The planning, laying out, installing, altering, 
  1.24  and repairing of technology circuits or systems must be 
  1.25  performed in accordance with the applicable requirements of the 
  2.1   National Electrical Code pursuant to section 326.243. 
  2.2      Sec. 2.  Minnesota Statutes 2002, section 326.01, is 
  2.3   amended by adding a subdivision to read: 
  2.4      Subd. 6n.  [ENERGY MANAGEMENT CIRCUITS OR SYSTEMS.] The 
  2.5   term "energy management circuits or systems" means a class 2 or 
  2.6   class 3 circuit or system that is used to control heating, 
  2.7   ventilating, air conditioning, or lighting. 
  2.8      Sec. 3.  Minnesota Statutes 2002, section 326.245, 
  2.9   subdivision 2, is amended to read: 
  2.10     Subd. 2.  [ELECTRICAL APPLIANCE UNITS.] Installation, 
  2.11  replacement, or alteration, of electrical components in or on 
  2.12  electrical appliance units or repair of such electrical 
  2.13  appliance units components are not covered by sections 326.241 
  2.14  to 326.248 326.242 and 326.244.  For the purposes of this 
  2.15  section, "electrical appliance units" means all electrical and 
  2.16  fossil fuel appliances that use electricity including, but not 
  2.17  limited to, furnaces, water heaters, stoves, clothes washers, 
  2.18  dryers, and dishwashers.  The installation of electrical wiring 
  2.19  to an electrical appliance unit is covered by sections 326.241 
  2.20  to 326.248. 
  2.21     Sec. 4.  Minnesota Statutes 2002, section 326.245, 
  2.22  subdivision 3, is amended to read: 
  2.23     Subd. 3.  [OTHER UNITS.] Planning, laying out, and 
  2.24  installation of heating, ventilating, air conditioning, or 
  2.25  refrigeration units are not covered by sections 326.241 to 
  2.26  326.248 326.242 and 326.244.  For purposes of this section, 
  2.27  heating, ventilating, air conditioning, or refrigeration units 
  2.28  include, but are not limited to, air conditioning units, air 
  2.29  conditioning evaporators, air conditioning condensers, air 
  2.30  conditioning and refrigeration chillers, boilers, furnaces, air 
  2.31  handling units, rooftop units, humidifiers, ice makers, and 
  2.32  supermarket, ice arena, and bar/restaurant equipment.  The 
  2.33  installation of electrical wiring to the unit is covered by 
  2.34  sections 326.241 to 326.248. 
  2.35     Sec. 5.  Minnesota Statutes 2002, section 326.245, 
  2.36  subdivision 4, is amended to read: 
  3.1      Subd. 4.  [OTHER EQUIPMENT.] Planning, laying out, 
  3.2   alteration, replacement, or repair of heating, ventilating, air 
  3.3   conditioning, or refrigeration equipment, and associated the 
  3.4   original electrical devices, controls, and wiring including 
  3.5   original wiring in or on the equipment, are or replacement of 
  3.6   such equipment when it is defective, is not covered by sections 
  3.7   326.241 to 326.248 326.242 and 326.244 when the work is 
  3.8   performed by an employee of a heating, ventilating, air 
  3.9   conditioning, or refrigeration contractor provided that the 
  3.10  employee performing the work has received a certificate of 
  3.11  completion from a heating, ventilating, air conditioning, or 
  3.12  refrigeration apprenticeship program approved by the state of 
  3.13  Minnesota or any class of personal electrical license issued by 
  3.14  the board the work is performed by an individual who possesses a 
  3.15  Minnesota Class A Master, Class A Journeyman, or Maintenance 
  3.16  Electrician License.  Employees registered in an approved 
  3.17  heating, ventilating, air conditioning, or refrigeration program 
  3.18  may design, plan, alter, replace, or repair heating, 
  3.19  ventilating, air conditioning, or refrigeration equipment, 
  3.20  devices, and controls including, and wiring in or on the 
  3.21  equipment, under the direction of an employee who has a 
  3.22  certificate of completion from an approved program or any class 
  3.23  of personal electrical license issued by the board possesses a 
  3.24  Minnesota Class A Master, Class A Journeyman, or Maintenance 
  3.25  Electrician License.  The installation, alteration, replacement, 
  3.26  modification, or extension of premises electrical wiring to the 
  3.27  unit is covered by sections 326.241 to 326.248.
