E Providing for the organization, operation and financing of state + government; appropriating money for transportation, public safety and certain +other purposes ARTICLE 1 � TRANSPORTATION AND OTHER AGENCIES APPROPRIATIONS Appropriating money to the commissioner of transportation for +multimodal systems including aeronautics, transit, freight and commercial +vehicles, for state and local roads and general support and services, to the +metropolitan council for bus transit and rail operations and to the commissioner +of public safety for administration and related services including public +safety officer survivor benefits, for the state patrol, for driver and vehicle +services and for traffic and pipeline safety; reducing certain base budgets; +providing for the continued availability of certain appropriations and for certain +fund transfers; providing for the refinancing of certain previously +authorized trunk highway projects from the trunk highway bond proceeds account in the +trunk highway fund, transferring certain prior appropriations to the +general fund and authorizing the issuance of state bonds; requiring budget base +reduction reports to the legislature by the commissioners of transportation and+ public safety and the chair of the metropolitan council; prohibiting the +commissioner of transportation from assigning mobile telephones or pagers to +department employees and requiring sale of previously assigned telephones and +pagers; restricting the expenditure of state funds on DOT employee travel; +providing for the financing of general contingent accounts and for the payment +of tort claims ARTICLE 2 � TRANSPORTATION FINANCE Modifying the county state aid highway fund apportionment formula, +providing for an apportionment sum and an excess sum; modifying the motor +vehicle registration tax depreciation schedule and eliminating certain +limits; creating a transit ways fund for public transit purposes, specifying certain +use priorities; increasing the gasoline and special fuels tax rates; +modifying the allocation of revenues from the sales tax on motor vehicles to the +highway user tax distribution fund; appropriating money to the commissioner of transportation (DOT) for state and local road construction in fiscal +years 2004 and 2005, authorizing the commissioner to spend a certain amount of +money on trunk highway improvements from advance construction funds approved +by the federal highway administration, requiring reports to the legislature +on use; requiring the commissioner to use the appropriations to accelerate +the timeline for completion or performance of certain trunk highway projects ARTICLE 3 � TRANSPORTATION AND PUBLIC SAFETY Requiring the commissioner of transportation (DOT) to use the greater+ Minnesota transit fund for transit operations and related program +administration; specifying certain appraisal and negotiation requirements for the +acquisition of property for transportation facilities or purposes under eminent +domain, classifying the data provided to the property owner as public; +prohibiting the commissioner from awarding highway construction or engineering +services contracts using a reverse auction process; increasing the limit on reimbursement to private property owners for appraisal fees relating +to direct purchase under eminent domain; defining interregional corridor under +general road provisions; requiring road authorities to cooperate and +coordinate right-of-way activities with the highway cleanup efforts of +volunteers participating in adopt a highway programs; authorizing and providing +for commissioner rest area use lease agreements with local government +units or private or nonprofit entities, requiring a report to the legislature +by a certain date on the impact; authorizing the commissioner to charge +user fees to single occupant vehicle owners using designated trunk highway high +occupancy vehicle (HOV) lanes, requiring use of certain fee proceeds by the +metropolitan council to improve transit and carpooling services; establishing a +trunk highway corridor protection revolving loan account in the trunk +highway fund for loans to road authorities outside the metropolitan area to +purchase property, specifying certain property eligible for purchase with loan+ proceeds and providing for application and repayment; eliminating the +prohibition on payment of sales tax expenses from the trunk highway fund; +authorizing the commissioner to enter into agreements with Indian tribal authorities +to provide maintenance, design and construction to highways on tribal lands; +authorizing county boards vacating a county highway to designate the former +highway as a county cartway and restricting expenditures on the cartways; +prohibiting the reversion to towns of county highway rights-of-way removed from the +county highway system; authorizing transfer of jurisdiction over county +highways upon agreement between the county and the authority, agency or tribe of +transfer; expanding the requirement for the establishment of town cartways to +landowners with access to the land only over navigable waters; expanding the +definition of special mobile equipment for motor vehicle registration purposes to +truck mounted log loaders; modifying certain seasonal highway weight +limits; authorizing the issuance of more than one set of special license +plates to volunteer ambulance attendants, requiring return upon termination of +status; imposing certain license plate and sticker issuance fees; increasing +the motor vehicle transfer and title issuance fees; expanding the requirement +for drivers to stop after a traffic accident; establishing a speed limit for +school zones, providing for the establishment of lower or higher limits under +certain conditions; restricting the use of left lanes on lane highways; +expanding the prohibition on highway or street littering to cigarettes and imposing+ a surcharge on the fine for the offense; expanding the seat belt use +requirement, making violation of the requirement a primary offense and increasing +the violation fine; requiring and providing for the commissioner of +public safety to implement a monthly sampling program to verify automobile +insurance coverage; requiring commissioner suspension of drivers licenses for +failure to provide vehicle insurance, imposing a reinstatement fee and requiring attestation of insurance; imposing a surcharge on fines assessed for +traffic or motor vehicle law violations in state trooper apprehension or arrest +cases to fund state trooper training, creating a trooper training account in +the special revenue fund; modifying the prohibition on issuance of drivers +licenses to certain minors; modifying the restrictions on operation of motor +vehicles by provisional license holders; increasing the drivers license, permit +and identification (ID) card issuance and filing fees; increasing the fee+ for reinstatement of drivers licenses after revocation for driving while +impaired (DWI) offenses and modifying the allocation requirements; requiring +and providing for the commissioner of transportation to biannually +prepare highway user tax distribution and trunk highway fund revenues and +expenditures forecasts; providing for school districts development and +implementation of safe routes to school programs to enhance the safety of students +walking or bicycling to school, specifying certain grant requirements; reducing +the operating assistance percentages under the public transit subsidy +program, authorizing certain commissioner payment adjustments to certain +recipients; modifying certain conditions for reimbursement to public employers +for the costs of complying with certain health insurance continuation +coverage requirements for certain retired or separated peace officers and +firefighters suffering disabling injuries in the line of duty; granting the +commissioner of public safety certain administrative and enforcement powers relating +to motor vehicle registration and drivers license issuance, creating an +education and compliance account for the deposit of administrative penalty order +receipts; requiring towing policy and practice for vehicles in capitol complex +public parking spaces to conform to certain towing regulation provisions; +modifying the local government unit contribution requirement for airport +acquisition and project costs and increasing the amount required to be transferred by+ the commissioner of transportation from the state airports fund to the +hangar construction revolving account; extending the availability of certain+ funds appropriated to the commissioner for airport development and +assistance; eliminating the expiration date for a certain provision exempting +certain utility and recycling vehicles from certain highway weight +restrictions; correcting the direction of a certain prior appropriation from the +bond proceeds fund for a certain highway; requiring the commissioner to +remove certain requirements for maintaining interim pavement striping and to+ study the feasibility of using centerline rumble strips during highway +construction; requiring the commissioner and the metropolitan council to study the feasibility of implementing a bus rapid transit system in the I-35W +corridor from downtown Minneapolis through the cities of Richfield, +Bloomington, Burnsville and Lakeville and requiring a BRT report to the +legislature by a certain date; requiring and providing for public participation in the metropolitan airports commission (MAC) taxicab advisory committee; +requiring the metropolitan council to construct and maintain a transit center +in Brooklyn Center and prohibiting the council from reducing public access to +services and facilities at the Hubbard marketplace transit station; authorizing +Itasca county to exchange certain land to acquire real property for county +highway maintenance facilities; repealing the metropolitan area transit +appropriation account, a certain provision exempting drivers license revocation for+ failure to provide automobile insurance from certain department of commerce investigation procedures, the requirement for insurer notice to the commissioner of public safety of lapse in insurance coverage, +property tax replacement aid and certain rules setting license plate and +validation sticker fees and requiring the provision of certain insurance information +upon vehicle transfer ARTICLE 4 � DRIVERS LICENSE PROVISIONS Prohibiting the commissioner of public safety from including personal information on drivers licenses or identification cards without +specific legislative direction; requiring and providing for proof of identity +and residency in applying for drivers licenses, permits or ID cards, +requiring documents submitted to the commissioner in a foreign language to be +accompanied by a translation, requiring proof of residency at the time of +application and renewal and certain evidence in cases of name change; providing for +lawful short term admission status and prohibiting license or ID card +issuance to individuals without lawful admission status, requiring reissuance +without a status check date under certain conditions; specifying the physical characteristics of applicants required on drivers licenses and ID +cards; requiring invalidation of ID cards from other jurisdictions before +issuance of a Minnesota ID card; modifying the expiration date of drivers +licenses and ID cards, requiring the expiration date for applicants with lawful short+ term admission status to coincide with expiration of the federal admission+ period, specifying certain requirements for renewal; specifying certain +applicant image requirements for licenses, permits and ID cards; requiring applicant +compliance with incorporated federal regulations in the issuance of drivers +licenses with a hazardous materials endorsement, authorizing commissioner rules for implementation purposes (ja)
