E Relating to the organization, operation and financing of state + governmentARTICLE 1 � STATE GOVERNMENT APPROPRIATIONSAppropriating money to the legislative and executive branches of +state government with certain reductions; appropriating money to the +senate, the house of representatives and the legislative coordinating commission +for the revisor of statutes, for the legislative reference library (LRL) and +for the legislative audit and health care commissions, to the constitutional +officers, to the campaign finance and public disclosure, investment and capitol+ area architectural and planning boards (CAAPB), to the offices of +administrative hearings and of strategic and long range planning, to the +commissioner of administration for operations and facilities management, for the +office of technology, for management services including the state archaeologist+ and the developmental disabilities council and for public television and +radio grants, to the commissioner of finance for state financial management and for information and management services, to the commissioner of employee +relations (DOER) for employee insurance and for human resources management, to +the commissioner of revenue for tax system and accounts receivable +management, to the department of military affairs (adjutant general) for training +facilities maintenance, for general support, for enlistment incentives and for +emergency services, to the commissioner of veterans affairs for Vinland center +grants, to the veterans of foreign wars, to the military order of the purple +heart, to the disabled American veterans, to the gambling control board, to the +racing and amateur sports commissions, to the state lottery, to the Minnesota +state retirement system (MSRS) for the legislators and constitutional +officers retirement plans and to the Minneapolis employees retirement fund +(MERF); authorizing a legislative commission or subcommittee of the LCC to by resolution adopt reduced per diem payments for legislators attending +commission meetings and providing for legislative employee leaves without pay; +providing a separate appropriation for 2003 to the secretary of state for payment+ of attorney fees awarded by court order in a certain court case; +requiring the commissioner of administration to identify savings from reduced use +by state agencies of vehicles and telecommunication devices for deposit into +the general fund; requiring the commissioner of employee relations to convene a +work group to study the structure of current human resources processes and responsibilities relating to technology systems and report to the +legislature by a certain date; requiring a commissioner of revenue tax +noncompliance report to the legislature by a certain date and authorizing taxpayer +assistance services grants to nonprofit corporations; providing for certain fund transfers, cancelling certain prior appropriations to the general +fund and providing for continued availability of certain other appropriations,+ for the payment of tort claims and for the funding of certain general +contingent accounts ARTICLE 2 � STATE GOVERNMENT OPERATIONSTransferring the responsibility for appointing members of the +legislative commission on planning and fiscal policy (LCPFP) from the legislative coordinating commission (LCC) to the respective legislative bodies; +eliminating a certain reserves transfer requirement to fund retirement allowances+ granted to former legislators under the Minnesota state retirement system +(MSRS); establishing the help America vote act account for improvement of the administration of elections in compliance with the federal help +America vote act, providing for funding of the account; requiring the deposit of +fees collected by the campaign finance and public disclosure board in the +general fund, modifying certain lobbyist fee payment requirements and +authorizing the use of electronic signatures for certain reports and statements; +authorizing the commissioner of administration upon government entity request to +issue written opinions relating to compliance with and duties under the +open meeting law; setting a mandatory retirement age for administrative law and +compensation judges; providing for the reorganization of state government +executive branch agencies, establishing the position of governor's secretaries, +requiring and providing for appointment and supervision by the governor, granting +the secretaries certain discretionary authority and providing for +assignment of the secretaries to various agencies, providing for appointment of a task +force for planning purposes; modifying certain budget preparation requirements +of the governor and the commissioner of finance; requiring the commissioner +of administration to transfer a certain percentage of certain state bond+ funded property rental proceeds credited to the special revenue fund to the +general fund, eliminating the requirement for the commissioner to provide +duplicating and printing services to state departments and agencies and +prohibiting the commissioner or other state agency heads or constitutional officers +from leasing or otherwise acquiring motor vehicles for the exclusive use +of state officials or employees, excepting the governor; modifying certain +state procurement procedures, providing for contract amendments or +extensions and requiring legislative review, encouraging state employee reports of +procurement law or rule violations, modifying certain contract approval +requirements and certain professional or technical services contracting procedures and+ requiring performance evaluation of work done under the contracts; modifying +certain state debt collection procedures, providing for certain debtor +administrative or appeal rights; authorizing the office of technology in +consultation with the commissioner of finance to determine the cost effectiveness of +development and use of shared information and communications technology systems by +state agencies for the delivery of electronic government services under +certain new system development conditions, requiring the commissioner of +administration to establish reimbursement rates in cooperation with the commissioner of+ finance to be billed to agencies and other governmental entities to cover the development, operating, maintenance and administrative costs of the +shared systems; excluding public hospitals, clinics or health maintenance organizations (HMO) from the definition of political subdivision of +this state for public employee salary limits imposition purposes; modifying +certain provisions under the veterans service office grant program; expanding+ the fee imposition authority of the racing and amateur sports commissions; +increasing certain racing license fees, specifying certain remittal dates and +modifying the disposition of proceeds from license fees and fines, requiring +crediting to a racing and card playing regulation account in the special revenue +fund; making optional certain promotion, development and sponsorship duties+ of the amateur sports commission; requiring the commissioner of revenue to +deduct a fee from income tax refunds levied for federal income tax liabilities +payment purposes for deposit in the department revenue recapture revolving +fund; requiring the state board of assessors to charge certain fees; +increasing fees for debt setoffs against tax refunds under the revenue recapture act;+ imposing a paper filing fee on tax refund or return preparers for state tax +returns not filed electronically; increasing the annual foreign corporation +registration fee; imposing a corporate surety bond requirement on gas, heating, +ventilation, cooling, air conditioning, fuel burning or refrigeration (G/HVACR) +contractors for the benefit of persons suffering financial loss due to failure to+ comply with state mechanical code requirements; requiring the director of +the state lottery to transfer all unclaimed prize money from the lottery cash +flow account to the environment and natural resources trust and general +funds and to conduct a study analyzing the efficiency and performance of the +current state lottery system and report to the governor and the legislature by a +certain date; transferring regulatory authority over the radio communication +and emergency telecommunications systems from the commissioner of +administration to the commissioner of public safety; increasing the bonding authority +of the metropolitan council to provide money for the third phase of the +regionwide public safety radio communication system and to reimburse local +government units for first phase capital improvement costs and providing for implementation of and for the allocation of costs for certain +additional phases of the statewide system; adding a representative of the league of +Minnesota cities from greater Minnesota to the membership of the radio system +planning committee and extending the expiration date of the metropolitan radio+ board; eliminating the city of Detroit Lakes as a location of an office of +the settlement division of the office of administrative hearings; +reducing the salaries for legislators and constitutional officers, prohibiting +reduction of state or local government employee salaries; providing for funding +for the real estate task force through the real estate filing surcharge; requiring+ the department of public safety to conduct a study of and report to the +legislature on emergency medical services (EMS) preparedness and the relationship+ to the overall homeland security planning of the department; authorizing the commissioner of administration to contract for printing services +without determining the availability of state employees to perform the +services; specifying certain renumbering and cross reference change +instructions to the revisor of statutes; repealing the requirement for the commissioner +of employee relations (DOER) to develop a directory of state agency professional +and technical services ARTICLE 3 � CRIMINAL JUSTICE APPROPRIATIONSAppropriating money to the supreme court for operating expenses, for +civil legal services, for state court administration and for law library +operations, to the court of appeals, to the district and tax courts, to the board+ on judicial standards, to the uniform laws commission, to the department+ of human rights, to the commissioner of public safety for terrorism response +related equipment and training grants, for the bureau of criminal +apprehension for an Internet web site, for grants to local officials for cooperative +investigation of cross jurisdictional criminal activity, for laboratory activities +and for DWI (driving while impaired) lab analysis, for the state fire +marshal, for alcohol and gambling enforcement, for the crime victim services +center, for law enforcement and community grants and for the 911 emergency +telecommunications system, to the boards of peace officer standards and training (POST) +and private detective and protective agent services and to the office of +the crime victim ombudsman; establishing a priority for court maintenance of +funding levels for interpreter programming, the children's justice +initiative, guardian ad litem programming, services to victims of domestic and sexual +abuse, minimizing the closing of satellite courts and the Minnesota court +information system (MNCIS); requiring the commissioners of public safety and +transportation (DOT) to submit annual joint reports to the legislature on the +expenditure of federal funds available under the repeat offender transfer program; +prohibiting the commissioner of public safety from relocating or reassigning +emergency response team equipment currently stored in Duluth, Moorhead, St. +Paul or Rochester and from reducing appropriations for the DWI lab or +forensic labs or CriMNet to offset increased lease payments for the new BCA building; +requiring the commissioner to develop a plan for the use of CriMNet +appropriations to further completion of the CriMNet program and limiting expenditures +for CriMNet communications activity; requiring the commissioner to maintain the +current advisory councils for battered women, sexual assault and general +crime victims within the newly created office of justice programs; providing for +the continued availability of certain prior appropriations ARTICLE 4 � PUBLIC SAFETY AND JUDICIARY POLICY PROVISIONSMaking mandatory the optional requirement for the bureau of criminal apprehension to establish and maintain an Internet web site +containing public criminal history data and extending the date for collecting +the access fee accordingly, requiring deposit in the general fund; increasing +the tax court small claims division appeal fee; requiring the superintendent +of the BCA to collect an additional handing fee for FBI (federal bureau of +investigation) background fingerprint checks and authorizing a fee for +fingerprinting for employment or licensing purposes, requiring use by the commissioner +of public safety to maintain and improve the criminal record system; requiring +the commissioner to impose certain fees to provide secure dial up or +Internet access to the criminal justice data communications network for +criminal and noncriminal justice agencies; authorizing and providing for the +commissioner to charge hotels and resorts for fire inspections, requiring crediting +to a state fire marshal hotel inspection dedicated account in the special +revenue fund; requiring the state fire marshal to charge a certain fee to conduct +and administer the journeyman sprinkler fitter certification process, +requiring crediting to a dedicated account; requiring persons engaged in the +purchase, sale or use for purposes other than personal consumption of +alcoholic beverages or ethyl alcohol to obtain the appropriate regulatory +permits and identification cards from the commissioner of public safety, fee; +increasing certain court filing fees; requiring deposit of money received from +surcharges on criminal and traffic offenses and game and fish law fines and +forfeited bail in the general fund; changing the name of the crime victim oversight +act to the "Crime Victim Ombudsman Act", reestablishing the office, powers and +duties of the crime victim ombudsman under the act and transferring the +responsibilities of the commissioner of corrections back to the reestablished office; +regulating indoor fireworks displays; establishing the Minnesota alternative policing +strategies (MAPS) program pilot project to enhance community policing efforts, +providing for commissioner of public safety grants to a certain number of law +enforcement agencies; repealing a certain obsolete provision governing public +school fire inspections by the state fire marshal ARTICLE 5 � ECONOMIC DEVELOPMENT APPROPRIATIONSAppropriating money to the commissioner of commerce for financial +examinations, for the petroleum tank release cleanup board, for administrative +services, for market assurance, for energy and telecommunications and for weights +and measures, to the boards of accountancy, architecture, engineering, +land surveying, landscape architecture, geoscience and interior design and+ barber examiners, to the public utilities commission, to the councils on +black Minnesotans, Chicano-Latino affairs and Asian-Pacific Minnesotans and+ to the Indian affairs council; specifying certain fee assessment, collection+ and deposit requirements of the PUC ARTICLE 6 � DEPARTMENT OF COMMERCE AND BOARD OF BARBER EXAMINERS +POLICY PROVISIONSRequiring the board of barber examiners to collect certain fees, +requiring deposit in the general fund; increasing the petroleum inspection fee +and imposing the fee for inspection of liquified petroleum gas meter or +stationary dispenser inspections, requiring inspection duties to be performed by+ department of commerce staff (je, ja)
