SF 1163 Senate Long Description

Relating to natural resources; restricting the use of off highway +vehicles on public land, including off highway motorcycles and off road and +all-terrain vehicles in the definition of off highway vehicle; requiring an educational certificate for the operation of off highway+ vehicles on public land, requiring and providing for commissioner of natural +resources (DNR) revocation of the certificates for violation of operation +restrictions; authorizing conservation or other licensed peace officers to issue +civil citations for certain violations, specifying certain citation +requirements, providing for enforcement and for allocation of penalty amounts to +the local government units employing the officers issuing the citations, +requiring penalty amounts retained by the commissioner to be credited to the +appropriate off highway vehicle account for laws enforcement purposes, +authorizing appeal, prohibiting the imposition of both civil and misdemeanor penalties; +expanding certain environmental and safety education and training program +content requirements, requiring the issuance of certificates to all operators+ and expanding the authorized uses of the off highway vehicle accounts; +authorizing local government units to apply to the commissioner for assistance in+ paying restitution for property damage resulting from the use of off highway+ vehicles; requiring the commissioner to establish a comprehensive off road +vehicle environment and safety education and training program, specifying +certain course content and commissioner cooperation and consultation +requirements and imposing a fee for deposit in the off road vehicle account; +increasing the registration fees for ATVs; requiring recipients of grants in aid for+ motorized trail construction and maintenance to obtain opinions relating to the+ location of wetlands in proposed project areas and requiring commissioner +reduction of grant payments for certain recipient violations; expanding the +skiing, hiking and horseback riding trails registry to off highway vehicles; +requiring the commissioner to report to the legislature by a certain date on the +cost of maintaining and operating the current off highway vehicle trails +system, specifying certain report content requirements; appropriating money +to the commissioner of transportation (DOT) to determine ATV gasoline +consumption in the state, specifying certain study and reporting requirements; +requiring the commissioner of natural resources to review trail grant in aid +policies and procedures and report on the status of and recommendations for the +grant in aid program (mk)
