  1.1                          A bill for an act 
  1.2             relating to commerce; clarifying definition of budget 
  1.3             billing plan; amending Minnesota Statutes 2002, 
  1.4             section 216B.098, subdivision 2; repealing Minnesota 
  1.5             Statutes 2002, section 325E.015.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 216B.098, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [BUDGET BILLING PLANS.] A utility shall offer a 
  1.10  customer a budget billing plan for payment of charges for 
  1.11  service, including adequate notice to customers prior to 
  1.12  changing budget payment amounts.  A "budget billing plan" means 
  1.13  a billing method in which estimated annual energy consumption 
  1.14  costs are billed to the consumer in approximately equal monthly 
  1.15  payments.  Municipal utilities having 3,000 or fewer customers 
  1.16  are exempt from this requirement.  Municipal utilities having 
  1.17  more than 3,000 customers shall implement this requirement 
  1.18  before July 1, 2003. 
  1.19     Sec. 2.  [REPEALER.] 
  1.20     Minnesota Statutes 2002, section 325E.015, is repealed.
