Relating to the organization, operation and financing of state +government; appropriating money for jobs, housing and economic development +purposes ARTICLE 1 � APPROPRIATIONS, ECONOMIC DEVELOPMENT Appropriating money to the commissioner of trade and economic +development for Minnesota investment fund grants, for joint biotechnology and medical+ genomics research by the university of Minnesota and the Mayo foundation and +for grants to the rural policy and development center at Minnesota state +university, Mankato and to local government units for infrastructure +rehabilitation, for the Minnesota trade office, for the job skills partnership and +pathways programs, for the office of tourism, for administration, for +workforce and rehabilitation services and for state services for the blind, to +Minnesota Technology, Inc., to the housing finance agency for Roseau flood +assistance, for the affordable rental investment fund and for family homeless +prevention, to the commissioner of commerce for financial examinations, for the +petroleum tank release cleanup board, for administrative services, for market +assurance, for energy and telecommunications and for weights and measures, to +the boards of accountancy, architecture, engineering, land surveying, landscape architecture, geoscience and interior design, barber examiners and +arts, to the commissioner of labor and industry for workers compensation, for +workplace services and for general support, to the bureau of mediation +services, to the workers compensation court of appeals, to the public utilities +commission (PUC), to the Minnesota historical society for education and +outreach, for preservation and access, for the Minnesota international center, for +the air national guard and military museums and for Farmamerica, to the +council on black Minnesotans and the Chicano-Latino, Asian-Pacific Minnesotans +and Indian affairs councils and to the commissioner of education for emergency +services and transitional housing; specifying a priority for DTED commissioner+ joint venture marketing grants; providing for HFA equity take out loans; +prohibiting the Minnesota historical society from closing or eliminating public +access to historic sites to reduce the budget; cancelling certain unexpended +fund balances and portions of certain prior appropriations and +transferring certain other funds to the general fund ARTICLE 2 � DEPARTMENT OF COMMERCE POLICY PROVISIONSProhibiting certain government controlled or owned insurance +companies from transacting business in the state, exceptions; increasing the +general insurance company rates and forms filing fee and eliminating the +filing fee for large risk alternative rating option plans, clarifying the +alternative LRARO filing procedure for use by workers compensation insurers for certain employers; modifying the definition of qualified wind energy +conversion facility relating to land ownership for renewable energy production +incentive purposes; prohibiting the director of weights and measures in the +department of commerce from inspecting or charging a fee for liquid petroleum gas +measuring equipment and increasing the petroleum inspection fee and expanding +required use; providing for the suspension of mortgage credit certificate aid;+ requiring the commissioner of commerce to study the availability and +cost to ambulance services of vehicle and malpractice insurance and the +factors influencing cost increases and to report the results to the +legislature by a certain date; requiring the commerce department by a certain date to+ sell certain unclaimed property; repealing the humanities commission ARTICLE 3 � DEPARTMENT OF LABOR AND INDUSTRY POLICY PROVISIONS Merging the division of voluntary apprenticeship in the department of+ labor and industry with the division of labor standards into the division of +labor standards and apprenticeship; establishing the apprenticeship +registration account in the special revenue fund for deposit of the annual +registration fee to be imposed on sponsors for apprentices in the training program; +requiring the commissioner of labor and industry to temporarily impose a +surcharge on certain boiler inspection fees; repealing the labor education +advancement grant program ARTICLE 4 � DEPARTMENT OF ECONOMIC SECURITY POLICY PROVISIONSAuthorizing the rehabilitation council for the blind and the +rehabilitation advisory and independent living councils to conduct meetings by +telephone or other electronic means under certain conditions; requiring the +governor's workforce development council in consultation with representatives of+ the local workforce councils and local elected officials to study the current configuration of workforce service areas in the state and report on +efficiency and quality of service delivery improvement to the legislature by a +certain date ARTICLE 5 � PETROFUNDEliminating the exclusion of mobile storage tanks from the definition+ of tank for petroleum tank release compensation purposes, specifying a +reimbursement limit; expanding authorized fund expenditures to and providing for +assessment and removal of abandoned underground storage tanks; authorizing +applicants to request board issuance of multiparty checks in lieu of assigning the +right to receive reimbursement to lenders, contractors or consultants; +defining natural disaster area and authorizing the board to reimburse applicants for a+ certain percentage of pre-natural disaster estimated building or total market+ value under certain conditions; authorizing the board to deny corrective +action services consultant or contractor registrations or requests for +renewal under certain conditions; expanding the list of sections to be repealed and+ delaying the date of repeal; specifying certain state board tank removal +inventory and reimbursement requirements ARTICLE 6 � DEPARTMENT OF TRADE AND ECONOMIC DEVELOPMENT POLICY +PROVISIONSExpanding the mission of the department of trade and economic +development to the improvement of the quality of existing jobs and the purposes of +certain business loan programs to job enhancement, defining job enhancement; +modifying certain provisions under the rural challenge grant program, modifying+ the allocation of funds to regional organizations and expanding +authorized uses, limiting the amount of assistance per project and requiring projects +supported through the program to be used principally to benefit low income +persons; modifying certain revolving fund administration, organization +reporting and application appraisal content requirements; increasing the limit on +Minnesota investment fund grants and providing for delayed loan repayments +under certain financial difficulty conditions; authorizing the DTED commissioner to+ continue to accept loans for enrollment into the capital access program +without full premium payment; modifying certain rural rehabilitation revolving +account administration requirements, restricting the withdrawal of funds for administrative purposes; authorizing commissioner expenditure of +money for certain additional promotional expenses; expanding business subsidy +agreement content requirements; clarifying the purposes of the job skills +partnership program and authorizing the use of funds in the program to provide +training for certain low income individuals; eliminating the annual reporting +requirement of the job skills partnership board under the pathways program; +modifying the date for board allocation of funds, increasing the percent of funds +used for administrative expenses and requiring the commissioner to implement +certain rapid response activities; modifying the definition of low income +area under the urban initiative board; requiring the commissioner to analyze and+ report to the legislature by a certain date on the negative impacts of the +North American free trade agreement (NAFTA) and pending expansion under free trade +areas of the Americas (TRAA); repealing the definition of local government +unit under certain development provisions, certain provisions providing for microenterprise and local government unit loans, certain regional +cooperation requirements under the challenge grant program, a certain requirement+ for the commissioner to provide office space and staff for the job skills +partnership board, Minnesota Advantage, Inc. and the Minnesota world trade center ARTICLE 7 � VAPOR RECOVERY Requiring by a certain date certain vapor recovery equipment on +underground storage tanks at locations selling gasoline at retail in the +metropolitan area and on transport delivery vehicles delivering gasoline to the +locations, imposing penalties for violation, specifying certain equipment +certification requirements and preempting local or other state agency regulations ARTICLE 8 � MOTOR VEHICLE INSTALLMENT SALESModifying certain provisions regulating motor vehicle retail +installment sales; increasing the limit on document fees includable in the cash sale +price; modifying certain finance charge and retail installment contract +content requirements; modifying and expanding the remedies for vehicle sales +finance company violations, providing for the refund of excess charges, for +the recovery of damages, for the correction of errors, for the liability +of assignees and for the award of attorney fees and costs, exempting +sellers from liability for unintentional violations, prohibiting recovery actions +by multiple obligors and certain offsets and imposing a statute of +limitations for the actions ARTICLE 9 � MISCELLANOUSClarifying the classification as public of certain benefit data; +modifying the limit on the amount allowed to be spent for the acquisition of works +of art for state buildings and limiting the amount allowed to be used for +administrative expenses by the commissioner of administration; providing eligibility+ for state paid insurance and benefits to employees of certain supporting +organizations of Minnesota Technology, Inc. and employees of Minnesota project +innovation; modifying the definition of Indian for department of trade and +economic development (DTED) loans eligibility purposes; modifying the +membership requirements of the board of directors of Minnesota Technology, Inc.; sunsetting the project outreach advisory committee; eliminating the +required crediting of certain monies to the Minnesota technology account; +requiring the board of barber examiners to charge certain examination, +certification, license and registration fees; increasing the number of members of the public+ utilities commission required to live outside the metropolitan area; increasing+ the fee for licensure or certification of architects, professional engineers,+ land surveyors, landscape architects, geoscience professionals or interior designers; increasing and expanding the penalties for licensee or +employee sales of tobacco to minors, requiring uniformity; authorizing local +governments units to impose annual license fees for the retail sale of certain +sparklers, limit, prohibiting local units from prohibiting the retail display of+ legal fireworks and from imposing on retailers certain excess financial +guarantee requirements; requiring a joint utility regulatory review by the +chair of the PUC and the commissioner of commerce, requiring a primary focus on +certain rural concerns and a report to the legislature by a certain date; +transferring the responsibilities of the Indian affairs council in administering +the Indian business loan program to the department of trade and economic +development; excluding certain smaller farm labor manufactured home housing areas +from regulation as manufactured home parks; repealing certain cosmetology +license requirements and a certain rule providing for a schedule of fees to +be charged by the board of barber examiners (ra)
