Relating to the financing of state government, reducing appropriations and transferring certain funds ARTICLE 1 � EDUCATION FINANCEReducing certain prior appropriations to the commissioner of +children, families and learning (CFL) for the operating budget, for aids and grants, for+ school readiness, for early childhood family and community education, for +adult basic education aid, for American Indian tribal or grant schools, for best +practice and magnet school start up grants and for the Perpich center for arts education; modifying ECFE and school readiness reserve account limits+ and establishing a community education reserve account limit, authorizing+ school districts to apply to the commissioner for a waiver of the community +education reserve account limit under certain conditions; authorizing school +boards or adult basic education consortiums to adopt a sliding fee schedule +based on family income, requiring waiver of the fee for participants under a +certain age or unable to pay; increasing state total adult basic education aid +and modifying the formula; setting the adult basic education aid +guarantee for -2005; exempting school districts in statutory operating debt + from the community education reserve account limit and levy reduction for +fiscal years and 2004 ARTICLE 2 � HIGHER EDUCATION Reducing certain prior appropriations and the base appropriations for+ fiscal years 2004 and 2005 to the higher education services office, to the +board of trustees of the Minnesota state colleges and universities (MnSCU) and+ to the board of regents of the university of Minnesota; prohibiting HESO +from reducing state grant awards to meet the reductions and requiring transfer of a+ certain amount of unrestricted balances in the SELF loan reserve fund to the +general fund ARTICLE 3 � HEALTH AND HUMAN SERVICES Appropriating money to the commissioner of human services for TANF +(temporary assistance for needy families) indirect costs and for medical +assistance (MA) long term care waivers and home care and facilities grants; reducing +certain prior appropriations to the commissioner for agency management, for +children's services, medical assistance basic health care, general assistance +medical care, aging and adult service, community support, alternative care, +chemical dependency nonentitlement, supportive work and fraud prevention +investigation grants, for health care policy administration and for the +prescription drug and Minnesota family investment programs, to the commissioner of health +for long term care quality demonstration, health disparities, lead and family +planning grants, to the emergency medical services (EMS) regulatory board, to +the council on disability, to the ombudsmen for mental health and mental retardation and for families, to the veterans homes board and to the commissioner of children, families and learning (CFL) for child care development grants and for basic sliding fee and MFIP child care; +requiring certain fund transfers; delaying implementation of targeted case +management for home care recipients and of the common service menu option within +home and community based waivers; authorizing the use of TANF funds +appropriated to the commissioner of health for the home visiting program and allocated to+ community health boards and tribal governments for WIC client services; +cancelling a certain amount of money for tobacco use and prevention activities to +the general fund; defining federal poverty guidelines for child care +programs purposes; modifying certain income eligibility requirements for +applicants for child care assistance and eliminating the upper limit on the sliding +fee for child care services; increasing the minimum parent fee and basing the+ fixed percent of family gross income on federal poverty guidelines in lieu +of the state median income for eligibility purposes; increasing the parental contribution for children with mental retardation receiving certain +health care services; increasing the nursing home license surcharge and extending+ the deadline for facility election to participate in the medical +assistance program; reducing the medical assistance and GAMC fee for service +payment rates for inpatient and outpatient hospital services, exempting mental and +Indian health services and requiring deposit of certain resulting payment +increases in the general fund; eliminating the earned income disregard and +reinstating certain prior income limits or standards for families and children +for medical assistance eligibility purposes; modifying medical assistance +eligibility for certain noncitizens; requiring the commissioner of human services to +estimate the acquisition cost used in setting pharmacy reimbursement rates and eliminating the requirement for setting maximum allowable costs for +multisource drugs; requiring and setting copayments and copayment exceptions for +generic and brand name prescription drugs; reducing the income limit for +receipt of extended medical assistance for persons with increased employment +hours or income or losing the earned income credit; requiring counties owning +and operating nursing homes to transfer an additional amount per licensed+ bed to the medical assistance agency and requiring the commissioner to +increase medical assistance and GAMC payments to the facilities for fiscal +year 2003; restricting the transitional standard for MFIP to the cash portion +for certain noncitizens and modifying certain general citizenship requirements +for eligibility purposes; reducing the eligibility time limit for +emergency financial assistance and the limit for authorizing post-secondary +education or training in the MFIP program, providing for completion of previously +approved education plans under certain conditions; modifying certain +MinnesotaCare eligibility and ineligibility notice requirements; reducing a certain+ prior appropriation to the commissioner of children, families and learning +for child care service grants and requiring the commissioner to amend the child+ care assistance parent fee schedule; delaying medical assistance coverage +for home based intensive early intervention behavior therapy for children with+ autism; requiring the commissioner of human services to propose revisions to +the MFIP transitional standards for assistance units containing persons +ineligible for federal food benefits due to citizenship status; repealing the home +sharing grant program, the inclusion of the Fairview university medical +center in certain intergovernmental transfer requirements, the food assistance +program, state MFIP food aid to noncitizens, the current child care assistance+ parent fee schedule and the new medical assistance asset limit for families ARTICLE 4 � ENVIRONMENT AND NATURAL RESOURCES Reducing certain prior appropriations to the pollution control +agency, to the office of environmental assistance, to the Minnesota zoological +board, to the commissioner of natural resources (DNR) for land, mineral and water +resources, forest, parks and recreation, trails and waterways and fish and +wildlife management, for ecological services, for enforcement and for +operations support and to the board of water and soil resources (BOWSR); requiring +certain fund transfers and appropriation reductions; requiring the deposit of +revenue from the motor vehicle transfer fee and from the sales and use tax on +cigarettes in the general fund between certain dates ARTICLE 5 � ECONOMIC DEVELOPMENT Reducing certain prior appropriations to the commissioner of trade +and economic development (DTED) for contaminated site and investment fund grants, +for a grant to Blue Earth county for the rural advanced business +facilitation program pilot project, for the job skills partnership and pathways programs +and Minnesota film board film production stimulation grants, to Minnesota Technology, Inc., to the commissioner of economic security except for+ state workforce services for the blind, to the housing finance agency +(HFA), to the commissioner of commerce including a reduction for a school employee +insurance plan study, to the commissioner of labor and industry, to the bureau +of mediation services, to the Minnesota historical society, to the +councils on black Minnesotans, Chicano Latino affairs, Asian Pacific Minnesotans +and Indian affairs, to the board of the arts and to the humanities commission; +increasing the amount required to be transferred by the commissioner of finance +from the special compensation fund and requiring transfer of a certain amount +from the Minnesota minerals 21st century fund to the general fund ARTICLE 6 � TRANSPORTATION Providing an appropriation to the commissioner of transportation +(DOT) from the bond proceeds account in the trunk highway fund and authorizing the +issuance of state bonds for state road construction and cancelling or +transferring certain amounts from the state airports fund to the general fund; reducing +the trunk highway fund budget base for transit administration, for motor +carrier regulation, for central engineering services, for design and +construction engineering, for state road operations including the highway helper +and transportation worker programs and for general support; reducing the +budget of the metropolitan council and reducing certain prior appropriations to+ the commissioner of public safety for administration and driver and +vehicle services; requiring the commissioner of transportation to sell the +state airplane, proceeds to be deposited in the general fund; prohibiting +the commissioner of public safety from closing driver license examination+ stations before a certain date ARTICLE 7 � CRIMINAL JUSTICE APPROPRIATIONS Reducing certain prior appropriations to the supreme court, to the +court of appeals, to the district courts, to the uniform laws and sentencing +guidelines commissions, to the commissioners of human rights, corrections and +public safety, to the boards of public defense and private detective and +protective agency services and to the ombudsman for corrections; prohibiting +reversion of money in the public safety officers benefit account to the general +fund until payment of reimbursement claims and providing for the payment of +benefits to the estate of the officer under certain conditions; clarifying a +certain provision providing for the payment of continued health insurance +benefits to disabled peace officers or firefighters and modifying the payment of +public employer cost reimbursements, appropriating money to the commissioner+ of public safety to reimburse public employers previously denied reimbursement;+ requiring redirection of a certain reduction in a prior appropriation to the +peace officer standards and training (POST) board to the educational +opportunities program; abolishing the office of ombudsman for corrections and +requiring the ombudsman to deliver files, records and data to the Minnesota +historical society ARTICLE 8 � STATE GOVERNMENT REDUCTIONSReducing certain prior and base appropriations to the legislature, to+ the constitutional officers, to the office of strategic and long range +planning, to the department of administration for voting equipment grants and for +the state employees band, to the departments of finance, employee relations +(DOER), revenue and military and veterans affairs, to the amateur sports and +racing commissions and to the campaign finance and public disclosure, +investment and lawful gambling control boards; cancelling certain account balances +to the general fund including the balance of a certain prior appropriation +to the capitol area architectural and planning board (CAAPB) for design of +the Korean war veterans memorial ARTICLE 9 � TAXESDelaying the refund of sales taxes for the purchase of capital +equipmentARTICLE 10 � CAPITAL PROJECT CANCELLATIONS Accelerating the cancellation of unencumbered previous general fund appropriations for completed or abandoned capital projects and +cancelling certain prior general fund appropriations to the commissioner of +transportation (DOT) for port development assistance, to the commissioner of +children, families and learning (CFL) for youth enrichment grants, to the +commissioner of administration for bureau of criminal apprehension (BCA) offices and laboratories, for health and human services facilities predesign and +for agency relocation, for capitol area architectural and planning board (CAAPB)+ repair and conservation work and for a grant to the Minneapolis community +development agency (MCDA) for the Guthrie theater, to the public facilities +authority for the wastewater infrastructure program and to the commissioner of +trade and economic development (DTED) for redevelopment grants ARTICLE 11 � STATE GOVERNMENT LANGUAGEAuthorizing the commissioner of finance to require direct payroll +deposit for all state employees; eliminating certain mandated services of the +commissioner of administration to state agencies and certain restrictions on state+ agency contracts for professional or technical services; requiring +appointing authorities in the executive, legislative and judicial branches of +state government, the Minnesota state retirement system (MSRS), the +teachers retirement system (TRA), the public employees retirement association +(PERA), the metropolitan council and the state historical society to +determine the necessity of using mandatory unpaid leave to meet budget reduction +goals and imposing certain requirements and restrictions on use of the leave; +prohibiting executive branch officials from taking action to reduce +appropriations for grants or contracts for the transmission of legislative activities ARTICLE 12 �AGRICULTURE AND RURAL DEVELOPMENT Reducing certain prior appropriations to the commissioner of +agriculture for protection service including dairy development and profitability +enhancement teams, for agricultural marketing and development including the +certification program and beaver control, sustainable agriculture demonstration +project and value added agricultural product processing and marketing grants and +for administration and financial assistance and limiting certain ethanol +producer payments, to the board of animal health and to the agricultural +utilization research institute; transferring money from the methane digester loan+ account, the sustainable agriculture loan program and short rotation woody +crops grants to the general fund (ra)
