  1.1                          A bill for an act 
  1.2             relating to government purchasing; prohibiting 
  1.3             purchase of certain piping; proposing coding for new 
  1.4             law in Minnesota Statutes, chapters 16C; 471. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [16C.137] [PURCHASE OF PIPE PRODUCTS.] 
  1.7      An agency may not purchase any pipe, pipe fittings, valves, 
  1.8   or fire hydrants from any company or company subsidiary that has 
  1.9   been found to have willfully violated a standard of the federal 
  1.10  Occupational Safety and Health Act and regulations thereunder.  
  1.11  In addition, these products must not be located on public land 
  1.12  or rights-of-way. 
  1.13     [EFFECTIVE DATE.] This section is effective July 1, 2003. 
  1.14     Sec. 2.  [471.671] [PURCHASE OF PIPE PRODUCTS.] 
  1.15     Subdivision 1.  [DEFINITIONS.] For purposes of this 
  1.16  section, "public entity" means a county, town, city, school 
  1.17  district, watershed district, joint powers board, soil and water 
  1.18  conservation district, municipal utility, special district, 
  1.19  public authority, or other political subdivision authorized by 
  1.20  law to enter into contracts. 
  1.21     Subd. 2.  [PURCHASE AND LOCATION PROHIBITED.] A public 
  1.22  entity in the state may not purchase any pipe, pipe fittings, 
  1.23  valves, or fire hydrants from any company or company subsidiary 
  1.24  that has been found to have willfully violated a standard of the 
  1.25  federal Occupational Safety and Health Act and regulations 
  2.1   thereunder.  In addition, these products must not be located on 
  2.2   public land or rights-of-way. 
  2.3      [EFFECTIVE DATE.] This section is effective July 1, 2003.
