  1.1                          A bill for an act 
  1.2             relating to data privacy; clarifying a provision 
  1.3             classifying certain federally required data; amending 
  1.4             Minnesota Statutes 2002, section 13.35.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 13.35, is 
  1.7   amended to read: 
  1.8      13.35 [FEDERAL CONTRACTS AND AGREEMENTS DATA.] 
  1.9      To the extent that a federal agency requires it as a 
  1.10  condition for contracting with or releasing federally protected 
  1.11  data to a state agency or political subdivision, all government 
  1.12  data collected and maintained by the state agency or political 
  1.13  subdivision because that agency contracts or enters into an 
  1.14  agreement, memorandum of understanding, memorandum of agreement, 
  1.15  certification agreement, or other cooperative agreement with the 
  1.16  federal agency are classified as either private or nonpublic 
  1.17  depending on whether the data are data on individuals or 
  1.18  nonpublic data not on individuals.
