Relating to electionsARTICLE 1 � HAVA COMPLIANCEModifying certain election procedures to comply with the federal help+ America vote act; modifying certain provisions relating to the permanent +voter registration system, providing for an interactive computerized +statewide voter registration list; specifying certain additional requirements of the +statewide voter registration system and eliminating certain requirements of the+ secretary of state relating to the adoption of rules for the system; providing +separate procedures for voter registration in person and registration by mail +before election day; providing for completion of incomplete mail +registrations; modifying election day registration procedures; expanding the content requirements for registration applications and providing for +rectification of deficient applications; prohibiting the inclusion of complete social +security, drivers license or identification card (ID) numbers on shared copies +of the master or public information lists; making mandatory the option of +the secretary of state to withhold from the public information list the +names of registered voters placed under court ordered protection; modifying +certain requirements for the entry of registration information into the +statewide voter registration system, imposing certain time limits and requiring +secretary of state comparison of the information with the information contained in+ the department of public safety database for accuracy verification +purposes, agreement requirement; requiring the electronic transmission of +certain deceased voter and guardianship and felony conviction information to +the secretary of state by the commissioner of health and the state court administrator respectively; modifying certain requirements for the +posting of voting history; authorizing certain additional information on polling+ place rosters on an experimental basis; reducing the retention period for +polling place rosters; requiring the secretary of state to provide +information on voter registration and absentee balloting procedures to be used by absent +uniformed services voters; modifying certain requirements for the form and +recording of absentee ballot applications; specifying a certain recording +requirement of election judges relating to preventing absentee voters from voting +more than once, requiring return of the record to the county auditor or +municipal clerk with election day materials; requiring the secretary of state to +prescribe the form for the separate record of absentee ballots cast; expanding the +authorized procedures for alternative elections resulting from court orders +relating to closing the polls; providing for a voters bill of rights; requiring +voting systems after a certain date to be accessible to individuals with +disabilities and to be certified by an independent testing authority approved by +the secretary of state; eliminating secretary of state licensing of +electronic voting systems for experimental use, authorizing approval; requiring +certain agreements between the secretary of state and the commissioners of +health and public safety and the state court administrator to transfer death, +drivers license and felony conviction records electronically between agency +systems for county auditor availability purposes; requiring the secretary of +state to send a copy of a certain report required by HAVA to the legislature for +budget purposes; specifying certain requirements for inclusion of voters +without verifiable information on the voter registration list; specifying a +voter registration system availability requirement, temporarily requiring +view only access; granting the secretary of state certain rulemaking authority; specifying a state and local government unit maintenance of effort +requirement for activities funded by federal funds or for equipment expenditures ARTICLE 2 � ELECTIONS ADMINISTRATION TECHNICAL CHANGES Eliminating postmasters from the list for inclusion by the secretary +of state in the legislative manual, reducing the number of copies to be +printed and distributed and the number to be made available to legislators; +requiring certain multimember state agency data to be provided to the secretary+ of state in electronic format and expanding the required data to electronic +mail addresses, requiring publication of the data including member +vacancies on the web site of the secretary of state in lieu of publication in the +state register; clarifying certain requirements for drivers license or +identification card (ID) voter registration application; requiring school districts +to make available voter registration applications to eligible students, +completion of registration applications not to be a school district requirement; +requiring registration of inactive registrants; modifying the requirement for +county auditor offices to remain open before elections to accept absentee +ballot applications and imposing the requirements on the offices of city or +town clerks; clarifying certain nominating petition requirements; +modifying the time limit for candidate requests for the counting of write in votes; +clarifying the inclusion of school district elections and referenda under the time +limit for designation of new polling places; modifying certain election judge qualification requirements; qualifying home schooled students for +service as trainee election judges and eliminating the requirement for high +school students completion of or enrollment in a government course; +prohibiting the counting of trainee election judges toward the minimum required +number of election judges; modifying certain judicial election ballot form +requirements; modifying the procedure for the provision of official supplemental +ballots to absentee or requesting voters; authorizing county auditors or +municipal or school district clerks by written authorization to permit news media representatives to enter polling places for a limited period of time +to observe the voting process, restrictions; prohibiting use of the absence of +election judge initials on ballots to disqualify the ballots under certain +conditions; requiring county canvassing board reporting of write in candidates to+ the county auditor; limiting the scope of and modifying the procedure for+ automatic recounts; providing for postelection review of a certain number of +randomly selected precincts; providing for the placement of uncontested +judicial offices on the ballot; requiring the secretary of state to supply county +auditors with copies of example supplemental ballots and county auditors to +distribute copies to municipal and school district clerks before the election; +eliminating the authority of county auditors to issue certificates of legislative +special elections; requiring candidates for town supervisor to designate the +specific seat sought in multiple seat elections; extending the time limit for +municipal or school or hospital district clerk election notices to county +auditors and requiring county auditor notice to the secretary of state; clarifying+ certain canvassing requirements and transferring certain governing body or +municipal clerk canvassing duties to canvassing boards; requiring the printing +of the words official ballot on the front of optical scan voting system +ballots; permitting electronic filing of campaign finance reports; clarifying +the procedure for withdrawal of resignation from office; authorizing the consideration of ballot questions at annual town meetings; requiring +town treasurers to perform certain election duties of town clerks under +certain conditions; clarifying certain petition signature requirements to +initiate proceedings for the consolidation of municipalities; modifying the +filing period for affidavits of candidacy for hospital district elections ARTICLE 3 � CAMPAIGN MATERIAL DISCLAIMERSConforming election campaign material disclaimer requirements to +constitutional limits; clarifying the definition of campaign material and certain +disclaimer requirements, increasing the expenditure threshold and modifying the +distribution time limit (Ch. 293, 2004)
