  1.1                          A bill for an act 
  1.2             relating to retirement; public employees police and 
  1.3             fire plan; authorizing a certain retiree to rescind a 
  1.4             retirement annuity application and to apply for a 
  1.5             disability benefit. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [PUBLIC EMPLOYEES POLICE AND FIRE PLAN; 
  1.8   RECISION OF ANNUITY APPLICATION IN FAVOR OF DISABILITY BENEFIT 
  1.9   APPLICATION.] 
  1.10     (a) Notwithstanding Minnesota Statutes, section 353.29, 
  1.11  subdivision 7, or any other law to the contrary, an eligible 
  1.12  person described in paragraph (b) may revoke an application for 
  1.13  a retirement annuity from the public employees police and fire 
  1.14  plan and may file an application for a disability benefit from 
  1.15  the public employees police and fire plan, effective 
  1.16  retroactively to February 1, 2001. 
  1.17     (b) An eligible person is a person who: 
  1.18     (1) was born on August 6, 1949; 
  1.19     (2) was employed for 27 years with the city of West St. 
  1.20  Paul fire department; 
  1.21     (3) terminated employment with the city of West St. Paul on 
  1.22  January 31, 2001; 
  1.23     (4) filed six "first report of injury" documents for back 
  1.24  injuries with the city of West St. Paul between June 1984 and 
  1.25  December 2000; 
  2.1      (5) requested recision of his public employees police and 
  2.2   fire plan retirement annuity on February 16, 2001, and tendered 
  2.3   a personal check repaying the initial annuity amount; and 
  2.4      (6) unsuccessfully appealed to the public employees 
  2.5   retirement association board of trustees on May 10, 2001, for 
  2.6   authority to rescind a retirement annuity application and to 
  2.7   apply for a disability benefit. 
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective the day following final enactment.
