Modifying certain driving while impaired (DWI) provisions; providing for the use of approved testing methods other than the infrared breath testing instrument and for the validity of the tests; failure to provide a valid breath test to constitute test refusal for drivers license revocation purposes; authorizing the commissioner of public safety to adopt rules indicating approval of instruments for preliminary screening or chemical test for intoxication; expanding the general enforcement authority of the commissioner and granting the commissioner access to certain information and property for examination purposes; authorizing the commissioner to issue corrective, administrative penalty and cease and desist orders and authorizing actions for injunctive relief; requiring the commissioner to prepare a plan for the use of administrative penalty and cease and desist orders, public comment requirement; prescribing a procedure for the use of administrative penalty orders; authorizing and providing for the commissioner to deny, suspend or revoke applications for permits, licenses, registrations, appointments or certificates; prohibiting false information in required documents; providing for recovery of litigation costs and expenses; creating an education and compliance account for the deposit of administrative penalty order receipts, authorizing the commissioner to use money in the account for education and compliance activities for regulated parties (je)
