Relating to public safety; providing for integrated prevention, response to and investigation of terrorist activity ARTICLE 1 ANTITERRORIST INITIATIVES AND RESPONSE PROVISIONSModifying certain provisions under the Minnesota emergency management act of ; expanding the definition of emergency management to emergency waste and debris management and disposal; authorizing the governor to declare peacetime emergencies for environmental protection purposes, providing for cooperation with tribal authorities, authorizing procurement of facilities and other real property and granting the governor the authority to authorize the commissioner of the pollution control agency to suspend the operation of statutes, rules, permits and agreements for the expedited management and disposal of debris and waste; expanding the definition of security information under the government data practices act to include information relating to acts of terrorism and regulating accessibility; authorizing law enforcement agencies to collect and maintain data to assist criminal justice agencies in the investigation and prosecution of acts of terrorism, defining and classifying the data and regulating release; granting the commissioner of agriculture property access authority to obtain information, examine records or conduct investigations to respond to or prevent potential terrorist attacks, requiring a search warrant, classifying data collected; authorizing the placement of embargoes in geographical areas of the state to limit food or consumer commodity movement into or out of the embargoed areas during governor declared emergencies and providing for the payment of laboratory testing, inspection, investigation and food or consumer commodity disposal costs in certain criminal conviction cases; providing for the use of quarantine zones of control for humans, machinery and personal property and modifying the size limit; defining certain terms relating to motor carriers for motor vehicle registration purposes, requiring reporting to the registrar of the USDOT carrier number by carriers operating trucks over a certain weight; requiring and providing for the commissioner of public safety to conduct criminal and drivers license background checks on applicants for a drivers license hazardous materials endorsement, requiring imposition of a fee, classifying and regulating release of the results, authorizing commissioner issuance of temporary endorsements to certain applicants; requiring proof of residency upon application for or renewal of driving permits, drivers licenses or state identification cards, authorizing commissioner rules, standards and procedures; expanding the authorized use of information on drivers licenses and ID cards; providing for the expiration of drivers licenses and ID cards issued to noncitizens in the country on a short term basis; modifying certain recordkeeping requirements of the juvenile court in delinquency cases; modifying certain provisions under the hazardous materials incident response act, providing for mitigation by chemical assessment teams, expanding the definition of hazardous materials to chemical and biological substances and expanding plan content requirements to team locations; expanding the crime of first degree murder to causing the death of a human being while committing certain acts of terrorism and the definition of designated offense under the forfeiture law to certain additional felony level and gross misdemeanor violations; expanding the authority of the court to order the withholding of funds held by certain offenders in financial institutions to account holders charged with murder, explosive or incendiary device violations, use or possession of biological agents, toxic chemicals or toxins, terroristic threats or acts of terrorism; imposing penalties for trespass on utility property with the intent to tamper, damage or otherwise disrupt safe operation, authorizing arrest without warrant; imposing felony penalties for furthering terroristic activity through aggravated forgery; modifying the crime of terroristic threats, expanding the crime to threats of biological agents, toxic chemicals or toxins and increasing the penalties; expanding the wiretapping authority of investigative or law enforcement officers to offenses relating to terrorism and prescribing a procedure for interception of terrorist communications; specifying certain renumbering instructions to the revisor of statutes; repealing a certain provision requiring long term oversight of hazardous materials incidents by the PCA and the expiration date for a certain provision providing for temporary emergency restrictions on the movement of people, livestock and personal property ARTICLE 2 TERRORISMCreating the crimes of terrorism, hindering apprehension or prosecution for terrorism, solicitation to commit terrorism, use or possession of biological agents, toxic chemicals or toxins and use of hazardous material for the act of terrorism; prescribing penalties ARTICLE 3 APPROPRIATIONS FOR ANTITERRORIST INITIATIVESAppropriating money to the commissioner of public safety for bomb disposal and hazardous materials response, collapse structure capability, capitol security, weapons of mass destruction coordination training and exercise and data management systems and to the commissioner of agriculture and the board of animal health for domestic terrorism preparedness and response activities (mk)
