1.1 A bill for an act 1.2 relating to agriculture; prohibiting the 1.3 nontherapeutic use of animal feed containing certain 1.4 antibiotics; establishing a surcharge on all 1.5 commercial feeds sold that contain antibiotics; 1.6 appropriating money; amending Minnesota Statutes 2000, 1.7 sections 25.33, by adding a subdivision; 25.341, by 1.8 adding a subdivision; proposing coding for new law in 1.9 Minnesota Statutes, chapter 25. 1.10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.11 Section 1. Minnesota Statutes 2000, section 25.33, is 1.12 amended by adding a subdivision to read: 1.13 Subd. 8a. [NONTHERAPEUTIC USE.] "Nontherapeutic use" means 1.14 any use of an antimicrobial drug in animals in the absence of 1.15 disease, including the use for growth promotion, feed 1.16 efficiency, or disease prevention. 1.17 Sec. 2. Minnesota Statutes 2000, section 25.341, is 1.18 amended by adding a subdivision to read: 1.19 Subd. 2a. [COMMERCIAL FEED CONTAINING ANTIBIOTICS; 1.20 SURCHARGE.] (a) A registrant shall pay an annual surcharge on 1.21 all commercial feeds sold that contain antibiotics. The 1.22 surcharge is one percent of the registrant's annual gross sales 1.23 of all commercial feeds sold that contain antibiotics and are 1.24 used in Minnesota. Notwithstanding section 25.39, subdivision 1.25 4, money collected from the surcharge must be deposited in an 1.26 antibiotics surety account in the agricultural fund. The 1.27 principal of the antibiotics surety account may not be spent and 2.1 deposits must be paid back to the licensee five years after the 2.2 surcharge was paid. 2.3 (b) The earnings on the antibiotics surety account are 2.4 appropriated to the commissioner for: 2.5 (1) monitoring antibiotic resistance; 2.6 (2) surveillance of antimicrobial-resistant salmonella in 2.7 retail meats; 2.8 (3) monitoring for bacteria, resistant bacteria, and 2.9 antibiotic residues in drinking water supplies, including 2.10 surface water areas downstream from confined animal feeding 2.11 operations; and 2.12 (4) support for on-farm demonstrations of alternatives to 2.13 antibiotics for growth promotion. 2.14 Sec. 3. [25.385] [PROHIBITION ON THE NONTHERAPEUTIC USE OF 2.15 FEED CONTAINING CERTAIN ANTIBIOTICS.] 2.16 (a) After January 1, 2003, a person may not sell, buy, or 2.17 use animal feed containing fluoroquinolones for a nontherapeutic 2.18 use. 2.19 (b) After January 1, 2004, a person may not sell, buy, or 2.20 use animal feed containing penicillin, tetracycline, 2.21 erythromycin, lincomycin, tylosin, virginiamycin, or other 2.22 antibiotics used in human medicine for a nontherapeutic use. 2.23 (c) The commissioner may, by rule, prohibit the use of any 2.24 microbial agents for growth promotion in animals if the agent is 2.25 used in human therapies or is known to select for 2.26 cross-resistance to microbial agents used in human medicine.
