Regulating telephonic sales or solicitation calls (telemarketing); requiring registration of telephone solicitors making unsolicited telephonic calls with the commissioner of commerce, excepting solicitors working as employees of registered employers; prescribing the registration procedure; providing for registration renewal and requiring certain fees, requiring deposit in a special account and appropriating money in the account to the commissioner for administrative expenses; providing for telephone subscriber placement on a no sales solicitation calls listing by notice to the department of commerce, providing for annual renewal; requiring the department to periodically update the no call list; providing for access to the list by telephone solicitors, fee, requiring crediting to an account and appropriating money in the account to the commissioner for administrative expenses; authorizing the commissioner to contract with an agent for establishment and maintenance of the list; prohibiting solicitation calls to telephone numbers on the no call list and interference with caller identification (ID) services; requiring the commissioner to include Minnesota subscribers on a national no call list maintained by the federal communications commission (FCC) on the state list; classifying and restricting the release of information contained in the list; specifying certain customer notice requirements of telephone companies; granting the commissioner certain enforcement powers; violations to be a deceptive practice, authorizing attorney general actions against violators; requiring the commissioner to consult with representatives of state and local government, senior citizen organizations, telemarketing companies and other businesses to compile a list of educational tools to help consumers understand the options relating to telephone solicitations and to provide information on the department web site relating to the options (mk)
