E Relating to health; modifying certain requirements for prior authorization of health care services under utilization review procedures, requiring the opportunity for providers to request prior authorization of a health care service at any time, prohibiting utilization review organizations, health plan companies or claim administrators from charging a provider fee; enacting the "Minnesota Fair Health Plan Contracting Act", establishing procedures for the contracting of health care providers by health plan companies, exemptions; specifying certain contract and proposed amendment disclosure requirements; regulating payment rates; restricting service code changes by health plan companies; requiring health plan company notice and explanation of proposed recoupments to health care providers, providing for payment and authorizing appeal; prohibiting the use of unilateral terms in contracts relating to termination, indemnification or arbitration and regulating contract terminations; modifying certain provisions regulating network shadow contracting; changing the term network organization to health plan company; modifying certain provider consent requirements; specifying certain time limits for submittal of provider claims, requiring health plan company notice to providers of unclean claims and delayed payments; requiring automatic payment of interest with the original claim; requiring health plan companies or sponsors using data for utilization profiling to differentiate between providers or as a requirement for continued participation in the provider network to make certain information available to participating providers and agents before release, regulating release of the data; requiring the commissioner of health to assess options and develop recommendations on methods to make available to patients information on the expected costs of receiving treatment from a particular health care provider or health plan company and the quality of care and to report the recommendations to the legislature by a certain date, specifying certain recommendation and report content requirements (mk, ja)
