HF 3031 Senate Long Description

"Minnesota Emergency Health Powers Act", modifying and specifying certain conditions for declaring national security and peacetime emergencies; defining certain additional terms under the Minnesota emergency management act of 1996; expanding the emergency management authority of the governor relating to cooperative agreements, transportation and the transfer of personnel or functions of state agencies; authorizing and providing for governor declaration of national security or peacetime emergencies due to public health emergencies, specifying certain consultation requirements of the governor or state director of emergency management, requiring the governor and commissioner of health upon declaration of public health emergencies to immediately report to the legislature relating to imposition and effect; providing for automatic or legislative termination of declarations; granting the governor certain authority to provide for the safe disposition of dead human bodies resulting from public health emergencies and providing for identification of the bodies, classifying death investigation data obtained; maintaining the right of individuals to refuse medical treatment and examination and testing procedures, authorizing commissioner placement in isolation or quarantine of individuals suspected of infection with or exposure to communicable diseases or toxic agents under national security, peacetime or public health emergencies and refusing examination, testing or treatment, requiring health care providers notice to individuals of the right to refuse; classifying isolation and quarantine directive data; specifying certain requirements for isolation or quarantine of individuals or groups, requiring the commissioner to obtain an order from the district court, exception, providing for hearing and specifying certain requirements for judicial decisions; isolated or quarantined persons to retain the right to refuse treatment; restricting entrance to isolation or quarantine areas; granting the commissioner certain powers delegation authority; requiring the commissioner to study and submit recommendations to the legislature by a certain date on additional changes needed to strengthen the capacity of the state to deal with public health emergencies, specifying certain report and recommendation content and certain consultation requirements and requiring publication in the state register; sunset (Ch. 402, 2002)
