"Minnesota Anti-Terrorism Act of 2002"ARTICLE 1 POLICYProviding for the discouragement and punishment of terrorist acts in the state and for the enhancement of the ability of law enforcement to train and prepare for and to investigate and respond to acts of terrorism; expanding the definition of emergency management to emergency waste and debris management and disposal; authorizing the governor to declare peacetime emergencies for environmental protection purposes, providing for cooperation with tribal governments, granting the governor the authority to authorize the commissioner of the pollution control agency to exempt the management and disposal of debris and waste from specific requirements in statutes, rules, permits and agreements enforced by the PCA, requirements; authorizing closed meetings to receive security briefings and reports and to discuss issues relating to security systems, nonhealth related emergency response procedures and security deficiencies in public services, infrastructure and facilities under certain conditions; prohibiting false statements or information in applications for registration, licenses, certifications, permits or land application of contaminated soil or other media or in records, reports or investigations under certain pesticide, fertilizer, agricultural chemical or genetically engineered organism regulations; requiring and providing for aerial applicator license background checks; authorizing the placement of embargoes in geographical areas of the state to limit food or consumer commodity movement into or out of the embargoed areas during governor declared emergencies and providing for the payment of laboratory testing, inspection, investigation and food or consumer commodity disposal costs in certain criminal conviction cases; providing for the use of quarantine zones of control for humans, machinery and personal property and modifying the size limit; requiring and providing for the commissioner of health to establish a registry of individuals and entities possessing or maintaining biological agents, defining biological agent, specifying certain individual and entity registration requirements, classifying data in the registry and specifying conditions for release of the data by the commissioner, requiring the commissioner to cooperate with the federal centers for disease control and prevention and state and federal law enforcement agencies in investigations involving the release, theft or loss of biological agents and to impose certain penalties for willful violation of the requirements and providing for exemption from registration and reporting requirements under certain conditions; requiring reporting to the motor vehicle registrar of the USDOT carrier number by carriers operating trucks over a certain weight; requiring proof of residency upon application for or renewal of drivers permits or drivers licenses or state identification cards, authorizing commissioner of public safety rules, standards and procedures; providing for the expiration of drivers licenses and ID cards issued to noncitizens in the country on a short term basis; requiring applicants to comply with certain federal regulations before issuance or renewal of hazardous materials driver license endorsements, authorizing commissioner implementation rules; clarifying the definition of shipper for hazardous waste registration and permit purposes and providing a shipper registration exemption for certain hazardous materials carriers; modifying certain delinquency records sharing authority of the juvenile court; expanding the definitions of chemical assessment team and hazardous materials under the hazardous materials incident response act; requiring activation through the department of public safety division of emergency management duty officer as a condition of receiving reimbursement for bomb disposal expenses, authorizing the commissioner to authorize operations outside the state as part of mutual assistance plans; requiring the court to order certain sex offenders to provide additional biological specimens for future DNA analysis; expanding the crime of murder in the first degree to causing death while committing a felony involving terrorism; increasing the penalties for falsely reporting a crime; expanding the definition of designated offense under the forfeiture law to certain additional felony level violations; expanding the authority of the court to order the withholding of funds held by certain offenders in financial institutions to account holders charged with murder, explosive or incendiary device violations, use or possession of weapons of mass destruction, terroristic threats or acts of terrorism; imposing penalties for trespass on utility property with the intent to tamper, damage or otherwise disrupt safe operation or the provision of services, authorizing arrest without warrant; imposing felony penalties for furthering terroristic activity through aggravated forgery, for the placement of explosives or incendiary devices with intent to destroy or injure and for the manufacture, possession or use of weapons or simulated weapons of mass destruction; increasing the penalties for terroristic threats; creating the crimes of introducing or threatening to introduce livestock, captive cervidae, poultry and wild deer pathogens and certain acts of terrorism, penalties; expanding the definition of crime of violence to terrorism; expanding the wiretap authority of law enforcement officers; prohibiting remote computing or electronic communication service providers from disclosing subscriber or customer information to government entities, exceptions, requiring disclosure of certain information under certain conditions; requiring the commissioner of public safety in consultation with the director of the driver and vehicle services to submit a report to the legislature by a certain date specifying the best method to facilitate data exchange with the federal immigration and naturalization service (INS) relating to the official legal status of individuals seeking drivers licenses or identification cards and presenting a student visa as an identification document during the application process; sunsetting the closed meeting and wiretap provisionsARTICLE 2 APPROPRIATIONS Transferring a certain amount of money from the tobacco use prevention and local public health endowment fund to the general fund, requiring the commissioner of health to reduce certain tobacco use prevention grants accordingly; appropriating money to the commissioner of public safety for the purchase of terrorism response related equipment and training, for bomb disposal squads, for assessment teams, for the purchase of secure communications specialized radio units, for domestic preparedness response information technology, for increased security for the capitol complex, for additional collection of biological specimens for DNA testing, for color coded driver licenses and identification cards for noncitizens and for a study of the feasibility and cost of requiring tagging of explosives and of the issue of structural building collapse, providing for the distribution of federal funds for terrorism preparedness and response, specifying certain expenditure reporting requirements of the commissioner; appropriating money to the commissioner of health to establish and operate the biological gents registry; reducing the base budget for the department of corrections to eliminate extended juvenile jurisdiction reimbursement grants and abolishing the office of corrections; requiring the transfer of files, records and data to the Minnesota historical society(ra)
