E Relating to crime; expanding certain bureau of criminal apprehension (BCA) identification data collection requirements to disorderly conduct; expanding the definition of domestic abuse to criminal sexual conduct in the fifth degree, interference with an emergency call or harassment; exempting petitions for orders for protection from residency requirements; modifying and clarifying the provision imposing penalties for violation of orders for protection; specifying standards for domestic abuse programs and educational programs for offenders or abusing parties; requiring the court to order offender participation in and successful completion of a counseling or educational program as a condition of probation or stayed sentence under certain conditions, authorizing the court to order abusing parties to participate in and complete a counseling or educational program and requiring chemically dependent offenders or abusing parties to complete chemical dependency treatment before beginning a counseling or education program; specifying certain program and fee requirements, requiring and providing for the release of certain information to the victim and certain others, providing for notice to and privacy of victims; requiring offender or abusing party completion of a domestic abuse counseling or educational program before referral to marriage or couples counseling; requiring and providing for counselor or facilitator reports of program completion to the court and probation or corrections officers; defining qualified domestic violence related offense under the criminal code and expanding the application of certain criminal penalties for assault in the fifth degree, domestic assault and harassment and stalking crimes to the offenses; expanding the provision providing for bail in cases of domestic abuse or harassment to violations of protection or no contact orders and requiring additional findings before pretrial release of defendants accused of the crimes(ra, ja)
