E Relating to probate; authorizing and providing for the commissioner of human services to establish systems and records to fulfill human services licensing application requirements and to use the systems and records to obtain and provide criminal history data from the bureau of criminal apprehension (BCA) and data about substantiated maltreatment of minors or vulnerable adults for other purposes under certain conditions, requiring persons making requests to agree not to disclose the data to others without the consent of the subject of the data, authorizing the commissioner to recover the cost of obtaining and providing background study data by charging the person requesting the study a fee, limit; requiring and providing for the commissioner to obtain criminal history data from the national criminal records repository under certain conditions, authorizing a study fee for costs recovery purposes, authorizing the commissioner to require background study subjects to submit electronic fingerprint images to obtain data from the national criminal records repository, equipment contingency; requiring the court to require background studies before the appointment of guardians or conservators and periodically after appointment, specifying certain background study requirements and exemptions, authorizing appointment pending the results of the study under certain conditions; requiring the court to request the commissioner of human services to complete criminal history and maltreatment background studies under human services licensing provisions, specifying certain fee, consent and fingerprint requirements; requiring the commissioner to provide the court with information from the criminal justice information system (CJIS) and data relating to substantiated maltreatment of vulnerable adults within a certain number of days of receipt of the request, requiring inclusion of copies of the public portion of investigation memoranda in substantiated maltreatment cases and providing for the submission of certain additional information; requiring the commissioner to develop a form for the background study requests; requiring the court to notify the subjects of background studies of certain rights (je, ja)
