E Providing for the regulation of hospice providers by the commissioner of health separately from home care providers; providing a hospice bill of rights for the benefit of individuals receiving hospice care, providing for enforcement; requiring a copy of the rights to be provided to individuals at the time of hospice care initiation, requiring the copy to contain the addresses and telephone numbers of the office of health facility complaints and the office of ombudsman for older Minnesotans; requiring the commissioner to adopt rules for the regulation of hospice providers, specifying certain rule requirements and certain regulatory functions of the commissioner; specifying the relationship to other regulatory programs; prohibiting the use of certification by the federal medicare program as a requirement of medicaid payment for room and board services delivered in residential hospice facilities; requiring and providing for the licensure of hospice providers by the commissioner, specifying certain requirements for licensure, certain application acknowledgment requirements of the commissioner and certain background check requirements, specifying the license fees; granting the commissioner certain enforcement authority including license denial, suspension or revocation, specifying certain advance notice requirements, authorizing and providing for provider requests for stay under certain conditions, specifying certain factors to be considered by the commissioner in granting a stay, providing for injunctive relief and for the issuance of subpoenas, imposing a time limit for appeal; requiring the commissioner to ensure the availability of hospice care information referral services throughout the state; imposing a penalty for violation of the license requirements by persons involved in the management, operation or control of hospice providers; repealing the provision requiring licensure of hospice programs under home care licensure requirements upon adoption by the commissioner of rules regulating hospice providers (je, ja)
